# What core regulatory measures does the U.S. adopt to prevent transshipment for tariff evasion?

## Question

I am the head of a foreign trade enterprise based in Shanghai specializing in household air conditioner exports. Last week, a batch of cabinet air conditioners worth 280,000 USD was detained by U.S. Customs upon arrival at the Port of Los Angeles on the grounds of "suspected of evading anti-dumping duties via Southeast Asian transshipment". It has been detained for 8 days so far, incurring nearly 2,000 USD in demurrage and detention fees each day. Our entire team has been working around the clock for communication and coordination but has made no progress, and we are extremely anxious. We only heard scattered news before that the U.S. is tightening transshipment regulation, but we have no idea how they specifically verify and determine transshipment activities. We did export via direct sailing from Shanghai without any third-country transit. What valid proofs should we submit now to clear our suspicion? How should we arrange in advance in the future to avoid such unnecessary compliance misjudgments?

### Answer 1 — Best Answer

Many export enterprises hold the misunderstanding that "direct sailing exports will never be identified as transshipment". In fact，U.S. Customs conducts cross-verification from multiple dimensions including cargo category，origin marking，and supply chain trajectory. Even for direct sailing shipments，if origin markings are vague or logistics documents are incomplete，verification may still be triggered.

If valid proofs cannot be submitted in time，cargo will be detained for 30 to 60 days for verification，which will not only incur high demurrage and detention fees，but may also be subject to return. The enterprise will be added to the customs key monitoring list，and all subsequent shipments to the U.S. will face 100% inspection，directly disrupting supply chain stability.

Physical risk isolation can be implemented from two aspects: First，**strengthen origin marking management**，mark "Made in China" clearly and tamper-proof on the product body，inner and outer packaging，and user manuals，Second，**retain full-chain logistics vouchers**，including Shanghai Port loading receipts，manifests，vessel GPS trajectory records，etc。to ensure full traceability of cargo flow.

For the current detention situation，the exclusive loss mitigation tip is: Immediately entrust a local U.S. compliant customs broker to apply for the **fast verification channel**，submit direct sailing manifests，on-site loading photos，and CCPIT-certified certificate of origin. At the same time，you can apply for temporary storage of the goods in a bonded warehouse to greatly reduce demurrage costs.

### Answer 2

For U.S. Customs transshipment verification, focus should be placed on the consistency of origin declaration during the customs clearance process, to ensure that the origin information on the customs declaration fully matches the certificate of origin and product markings.

If questioned by customs, supplementary origin traceability proofs shall be submitted within 3 working days, including raw material procurement contracts, production process records, factory inspection reports, etc. Avoid "general origin declaration", for example, declaring assembled products as "Made in China" without clarifying assembly location details, as such vague statements can easily trigger customs valuation and verification. At the same time, if second-hand equipment or OEM products are involved, additional brand authorization certificates and production authorization documents shall be submitted to avoid being identified as transshipment to evade intellectual property regulations.

### Answer 3

From the logistics path perspective, if goods need to transit through a third-country port (even without container exchange), transit port information shall be clearly marked on the manifest in advance, and the shipping company shall be required to issue a "direct transit without container exchange" certificate to avoid U.S. Customs classifying transit activities as transshipment trade. In addition, cooperate with shipping companies holding U.S. Customs AEO certification, as their manifest data is prioritized for acceptance by U.S. Customs, which can reduce verification probability.

If goods have been detained at port, you can coordinate with the shipping company to apply for extended free storage and free container periods, or choose to transship goods to a bonded warehouse adjacent to the U.S. (such as bonded warehouses on the Mexican border) for temporary storage, and enter the U.S. only after verification is passed, to cut demurrage expenses. At the same time, retain real-time vessel trajectory data, including time nodes and GPS positioning of departure, arrival and transit, as core proof of cargo flow.

### Answer 4

In 2026, the U.S. upgraded its transshipment tax verification system, which automatically compares enterprises' export declaration data with overseas foreign exchange receipt data. Data mismatch will directly trigger a tax alert. U.S. transshipment prevention regulatory measures will directly affect the tax costs of export enterprises.

If identified as transshipment for tariff evasion, enterprises will not only need to pay high additional anti-dumping duties, but may also face fines equivalent to 20%-30% of the cargo value, and their export tax rebate qualification may be affected. Enterprises shall conduct tax planning in advance.

If exported products are included in the anti-dumping duty list, the applicable anti-dumping duty rate can be reduced by adjusting the product's raw material composition (such as increasing the proportion of local procurement), provided that the adjusted products still comply with origin rules. In addition, declare export tax rebates in time to avoid overdue declaration caused by cargo detention. If goods are returned, complete export tax rebate offset procedures within 15 days after the returned goods enter China, to avoid being listed as an abnormal declaration enterprise by tax authorities.

### Answer 5

In the payment and foreign exchange receipt link, ensure that the foreign exchange receipt account matches the overseas purchaser information on the customs declaration. If third-party foreign exchange receipt is involved, submit a third-party payment authorization certificate to the bank in advance, clarifying the reason for the payment and the relationship between the paying party and the purchaser, to avoid U.S. Customs taking third-party receipts as capital evidence of transshipment.

At the same time, use SWIFT messages or the CIPS system for cross-border payments, and retain complete payment vouchers and message records as proof of compliant capital flow. If listed on the U.S. Customs key monitoring list, report to the State Administration of Foreign Exchange in time and adjust the payment and receipt path to avoid foreign exchange settlement abnormalities. In addition, regularly review the qualifications of overseas purchasers, and avoid cooperating with purchasers with a history of transshipment trade to reduce compliance risks.

### Answer 6

When signing export contracts, explicitly add an "origin compliance clause", which stipulates that the purchaser shall not transship goods to a third country before transporting them to the U.S. If U.S. Customs detains goods due to the purchaser's transshipment activities, the purchaser shall bear all demurrage fees, fines and return costs. At the same time, retain all communication records with the purchaser, including emails and chat records, which can be used as legal evidence in case of disputes.

In addition, complete intellectual property customs protection registration in time to avoid goods being detained by U.S. Customs on suspicion of infringement. If identified as engaging in transshipment trade, you can entrust a local U.S. law firm to assist in applying for administrative reconsideration, and submit origin certificates, logistics vouchers and other materials to request revocation of the verification decision. If goods are returned, claim compensation from the purchaser in accordance with the contract terms.

### Answer 7

During on-site transshipment inspection, U.S. Customs focuses on checking the origin marking of goods, part markings inside products, and logistics traces on packaging. If the goods' packaging carries third-country port markings, barcodes or logistics labels, it is very likely to be identified as transshipment trade. Enterprises shall conduct pre-inspection before loading, remove all markings that may involve third countries, and ensure that origin information on packaging, products and manuals is consistent.

If subject to on-site inspection, cooperate with customs' unpacking inspection, prepare origin certificates, production records, procurement contracts and other materials in advance, and be accompanied by professional customs declaration staff during inspection to avoid misunderstanding caused by unclear expression. In addition, pay attention to the integrity of goods packaging. If packaging is damaged, re-seal it and mark the sealing time and location, to avoid suspicion of cargo replacement during transit.

### Answer 8

If goods are identified as transshipment by U.S. Customs, the enterprise's export tax rebate declaration will be marked as abnormal by tax authorities, and will be subject to correspondence verification covering the consistency of capital flow, cargo flow and invoice flow. Enterprises shall retain all export-related documents in advance, including procurement invoices, customs declarations, bills of lading, and foreign exchange receipts, to ensure consistency of the four core flows.

If goods are returned, apply to the tax authority for export tax rebate offset in time after the returned goods enter China, to avoid excess tax rebates caused by delayed offset, which may lead to fines and late fees. In addition, conduct regular export tax rebate self-inspection, focusing on the accuracy of origin declaration and completeness of documents, to avoid failed tax rebate declarations due to missing documents, and reduce the probability of triggering tax authority verification.
