# What Taxes Are Payable on Agent Export Business Revenue

## Question

I am the finance director of a small electromechanical product export enterprise. We have just taken on an agent export order recently to help a client export a batch of water pumps to Southeast Asia. Previously we mainly engaged in self-operated export, so we are completely unfamiliar with the tax treatment of agent export. I have been struggling with these questions these days: What taxes should be paid for the agency revenue? Should VAT be paid based on the full amount or the差额? The foreign exchange remitted by the client, after deducting the agency fee, needs to be transferred to the factory. Will this part affect the tax base? I heard that agent export can enjoy tax exemption only when certain conditions are met. Are there any parts that need to be adjusted in our current contract terms? If we pay taxes incorrectly, it will not only increase costs but also may lead to penalties. I am really anxious and hope to get clear guidance.

### Answer 1 — Best Answer

In agent export business，the core of revenue tax payment is to distinguish between agency mode and self-operated mode，so as to avoid the increase of tax cost caused by mode confusion. Under the traditional mode，some enterprises mistakenly pay VAT on the full amount of agency income as self-operated business，or fail to accurately collect costs，resulting in a high income tax base.

For the optimization path，first clarify the VAT treatment: If the consignor completes customs declaration and foreign exchange collection by itself，and the agent only charges agency fees，the agency income can apply for **VAT exemption**. Secondly，the calculation basis of corporate income tax is the net amount of agency fee (revenue minus direct costs such as customs declaration fee and logistics fee)，rather than the full amount of foreign exchange.

Three conditions shall be met for eligibility: sign a standardized agency contract，retain complete documents (entrusted customs declaration agreement，bill of lading，etc.)，and complete tax exemption filing. Revenue calculation shows that compliant operation can reduce VAT cost by 3%-6%，and net-based income tax calculation can reduce taxable income by 10%-20%.

It should be noted that the revenue and expenditure of **agency business shall be accounted for separately**，to avoid mixing with self-operated business which leads to the cancellation of tax exemption qualification. Regularly check that the foreign exchange collection flow is consistent with the contract. If there is any error in handling，correct the declaration in time to reduce compliance risks.

### Answer 2

The "trade mode" on the agent export customs declaration form shall be accurately filled in as "agent export" (code 1900). Incorrectly filling in "general trade" will be identified as self-operated business, requiring full payment of VAT.

The "consignor and consignee" shall be filled with the consignor, and the "declaration unit" shall be filled with the agent, which shall correspond to each other. Check the consignor's documents before customs declaration to ensure accurate information and avoid tax risks caused by customs declaration errors.

### Answer 3

The ownership transfer document of agent export goods is the key to tax compliance. The "consignee" on the bill of lading shall be the overseas customer, the "notify party" shall comply with the contract agreement, and the endorsement shall be standardized.

The logistics fee payment voucher shall correspond to the contract. If the fee is directly paid by the consignor, the contract between the consignor and the logistics company and the payment slip shall be retained as the basis for cost accounting to avoid a high income tax base.

### Answer 4

Agency fees for acting on behalf of overseas enterprises belong to cross-border service revenue, which can apply for **zero VAT rate** (the service is required to be fully incurred overseas). When the consignor is a non-resident enterprise, the agent shall withhold and pay 10% non-resident enterprise income tax (preferential treatment is available under tax treaties). The contract shall specify the party bearing taxes and fees, and make use of cross-border service tax exemption policies to reduce VAT costs.

### Answer 5

Agent export shall follow the principle of "who exports, who collects foreign exchange". The consignor collects foreign exchange directly, and the agent only charges agency fees.

If the foreign exchange is first remitted to the agent's account, it shall be transferred within 30 days with relevant vouchers retained, and "agent export foreign exchange collection" shall be filed in the foreign exchange system. Non-standard foreign exchange receipt and payment procedures will be identified as self-operated business, facing tax and foreign exchange penalties.

### Answer 6

The agency contract shall clearly specify the "agency nature" and avoid the expression of "buyout agency", otherwise it will be identified as self-operated business.

The contract shall clearly stipulate the agency fee, ownership of goods, responsibility for foreign exchange collection, add document compliance clauses, and clarify the responsibility for risks caused by the consignor's document problems. Standardized contracts are an important basis for tax authorities to identify the authenticity of agency relationship.

### Answer 7

When inspecting agent export goods, it is necessary to provide documents such as agency contract and entrusted customs declaration agreement to prove that the ownership of the goods belongs to the consignor.

If the inspection finds that the goods information is inconsistent with the customs declaration form, it will affect the subsequent tax treatment. The ownership certificate in the inspection result is a key attachment for tax exemption filing, so the inspection record and relevant documents shall be retained.

### Answer 8

The packaging of agent export goods shall meet the requirements of the destination country, and the packaging documents shall be consistent with the customs declaration form.

If the packaging is unqualified and the goods are detained at customs, the foreign exchange collection will be delayed, which will affect the recognition of agency revenue and income tax declaration. If the packaging fee is borne by the agent, the contract and invoice shall be retained as the basis for cost deduction to avoid overpayment of income tax.

### Answer 9

To apply for VAT exemption for agent export, document filing shall be completed within 15 days after export, including agency contract, customs declaration form, bill of lading, etc. Failure to file on time or incomplete materials will lead to the cancellation of tax exemption qualification and require supplementary payment of VAT.

The audit will check the "consistency of four flows", and the inconsistency between the agency capital flow and the contract will be identified as a violation. It is necessary to establish a filing system to check materials regularly.

### Answer 10

The revenue and expenditure of agent and self-operated export business shall be accounted for separately to avoid mixed operations leading to tax risks. Optimizing the supply chain path (such as direct shipping to reduce transit) can shorten the foreign exchange collection time, accelerate the recognition of agency revenue, and avoid delayed income tax declaration.

Supply chain planning shall consider tax compliance to ensure that documents and capital flows are consistent in all links and reduce the overall tax cost.
