# What are the compliant payment methods and key operational points for agent import of goods?

## Question

I am the head of a small and micro enterprise engaged in precision instrument import in Shanghai. Recently, we imported a batch of German equipment through an agency company for the first time, and now we have come to the payment stage, which makes me extremely anxious. I heard before that peers incurred more than one hundred thousand yuan in extra costs due to goods detention at the port caused by non-compliant payment processes, and some had goods detained by customs because they failed to catch the payment node. Besides, our capital is not abundant, so I am afraid that choosing the wrong payment method will increase exchange difference and tax difference costs, and I also worry about whether there are hidden compliance pitfalls in the payment operation of the agency company. We have documents such as contracts and invoices on hand now, but we do not know whether we need to find a third party for review in advance, nor do we know how to connect the customs declaration and logistics nodes when making payment, and how to remedy if there is a delay in foreign exchange payment. I am really too anxious to sleep, and I just want to figure out how to make payment safely, compliantly and cost-effectively.

### Answer 1 — Best Answer

First of all，for the details of pre-document review，it is necessary to focus on verifying the consistency of **import contracts，commercial invoices and bills of lading**，to ensure that the payment amount，currency type and payment term fully match the agency agreement. At the same time，confirm in advance that there is no deviation between the pre-entry information of the customs declaration form and the documents，so as to avoid failure of customs clearance after payment due to inconsistent documents.

For the connection of core nodes，it is necessary to follow the process of "document review passed → agency company issues payment notice → enterprise transfers funds after confirmation → agency company completes cross-border foreign exchange payment → synchronously feeds back foreign exchange payment vouchers to the customs declaration department". The key point is to complete the foreign exchange payment procedures 3-5 days before the goods arrive at the port，to ensure that foreign exchange payment vouchers are complete during customs declaration and avoid port demurrage risks.

Abnormal response plans should be formulated in advance: if there is an error in document information，suspend payment immediately and coordinate with foreign suppliers to modify it before re-review，if the exchange rate fluctuates too much，the cost can be locked through **foreign exchange hedging operations**，if the agency company delays foreign exchange payment，the party bearing port demurrage and container rental fees shall be agreed in advance.

For the final compliant implementation，all foreign exchange payment vouchers，agency agreements and document copies shall be retained for at least 5 years to ensure compliance with the compliance requirements of the customs and the State Administration of Foreign Exchange. At the same time，the agency company shall be required to provide foreign exchange payment slips and verification vouchers to complete the closed loop of the whole payment process.

### Answer 2

Agent import payment is closely related to the customs declaration link, and the payment amount must strictly match the dutiable value declared on the customs declaration form. If there is a deviation between the payment amount and the valuation conclusion, the customs will launch the customs valuation dispute process, resulting in goods detention, port demurrage and additional costs.

It is necessary to submit payment vouchers to the customs declaration department for pre-review in advance to ensure that miscellaneous fees such as freight and insurance premium included in the payment amount comply with customs valuation rules. If there are additional fees such as sample fees and technical service fees, it is necessary to declare to the customs in advance and include them in the dutiable value, so as to avoid customs declaration delays and fines caused by inconsistent valuation.

### Answer 3

The agent import payment node must be accurately matched with the logistics rhythm. If payment delay leads to failure to endorse and transfer the bill of lading in time, the goods cannot be picked up, resulting in chain costs such as container detention fees and port demurrage fees.

Payment shall be completed within 7 days after the goods are loaded and before arrival at the port, to ensure that the agency company obtains the full set of original bills of lading in time and completes the endorsement. If a telex release bill of lading is adopted, the agency company shall be required to send the telex release guarantee letter to the shipping company immediately after payment, and confirm that the shipping company has received the guarantee letter and agreed to release the goods, so as to avoid delivery delay caused by bill of lading problems.

### Answer 4

When making agent import payment, the VAT deferment policy can be used to reduce capital occupation costs. If the enterprise meets the VAT deferment access conditions, there is no need to prepay import VAT at the time of payment, and tax declaration can be made in the subsequent declaration period, thus saving a large amount of working capital.

It should be noted that VAT deferment is only applicable to eligible imported goods, and it is necessary to file with the tax authority in advance. The payment voucher must clearly indicate the tariff code corresponding to the goods to ensure consistency with the filing information, so as to avoid tax penalties and cancellation of deferment qualification caused by non-compliance with requirements.

### Answer 5

Agent import payment must strictly comply with the cross-border receipt and payment compliance requirements of the State Administration of Foreign Exchange. RMB cross-border payment shall be completed through the CIPS system or foreign currency payment shall be completed through the SWIFT system.

All payments shall be supported by authentic and valid trade background documents, including import contracts, commercial invoices, bills of lading, etc. If an offshore account is used for payment, it is necessary to ensure that the source of account funds is compliant, so as to avoid investigation by the State Administration of Foreign Exchange and account freezing caused by unknown sources of funds. At the same time, the foreign exchange purchase rate shall be optimized, and exchange difference costs can be reduced by means of batch foreign exchange purchase and foreign exchange hedging.

### Answer 6

Clauses such as payment conditions, payment nodes and liability for breach of contract shall be clearly specified in the agency agreement for agent import payment. If letter of credit payment is adopted, the soft clauses of the letter of credit shall be strictly reviewed to avoid payment risks caused by soft clauses.

It shall be agreed that if the agency company fails to pay foreign exchange on time, resulting in port demurrage and customs detention of goods, the agency company shall bear all losses. At the same time, the retention requirements of payment vouchers and dispute resolution methods shall be clarified to ensure that legitimate rights and interests can be protected through legal channels in case of payment disputes.

### Answer 7

After the agent import payment is completed, if the goods need on-site inspection, it is necessary to ensure that the payment voucher is consistent with the information of the inspected goods, including the name, quantity and amount of the goods. If it is found during inspection that the payment amount is inconsistent with the actual value of the goods, the customs will launch an anti-smuggling process, resulting in goods detention.

The payment voucher shall be submitted to the on-site inspection department in advance to ensure that relevant supporting materials can be provided in time during inspection. If there is information inconsistency, immediately coordinate the agency company to communicate with foreign suppliers and provide supplementary supporting materials to avoid inspection delay.

### Answer 8

If the agent imported goods are dangerous goods, the payment amount shall include the relevant costs of special packaging. It is necessary to ensure that the amount and purpose of the packaging cost are clearly indicated in the payment voucher, so as to avoid unqualified packaging caused by the packaging cost not being included in the payment scope, which will lead to customs detention of goods and port demurrage.

Check the consistency between the MSDS report and the packaging cost information in the payment voucher in advance to ensure that the packaging meets the UN dangerous goods packaging standards. If the packaging cost is not reflected in the payment voucher, relevant supporting materials shall be supplemented to avoid customs clearance delay caused by packaging problems.

### Answer 9

If the enterprise is also involved in export business, the agent import payment shall ensure that the capital flow is consistent with the goods flow and document flow, so as to avoid affecting the export tax refund due to capital return problems.

The agent import payment vouchers and export tax refund documents shall be stored separately to ensure that the import payment funds are not used for the capital return of export business. If there is cross use of funds, a clear capital flow certificate shall be provided to avoid export tax refund delay and penalty caused by tax correspondence investigation.

### Answer 10

Agent import payment shall be included in the supply chain cost actuarial model, and factors such as payment method, exchange rate fluctuation and capital occupation cost shall be comprehensively considered. The payment node can be optimized through the conversion of CIF/FOB trade terms.

If FOB terms are adopted, payment can be made after the goods are loaded on board, reducing the capital occupation time. It is necessary to establish an inventory linkage strategy, adjust the payment rhythm according to the inventory level, avoid capital overstock caused by advance payment, and dynamically calculate the income ratio through the cost actuarial model to ensure that the payment method conforms to the enterprise's supply chain strategy.
