# What to Do If Cargo Is Detained Due to Wrong Packaging Marking by Freight Forwarder

## Question

I am the foreign trade manager of a small and medium-sized enterprise mainly engaged in the export of precision optical instruments, and this recent shipment has totally stressed me out! Last month, we shipped 20 cases of lenses to Hamburg, Germany. The freight forwarder said it would go via direct fast vessel, but after arrival the cargo was inspected by customs — which found we incorrectly marked UN3082 on the packaging (this is actually general cargo, the packaging factory marked it wrong). Now the cargo is detained in the port warehouse, and we have already incurred 5 days of container detention charge and storage charge. Our client pushes for delivery and claims compensation every day, but the freight forwarder only tells us to wait for updates. Worse still, the customs declaration documents for this shipment were prepared by the freight forwarder, and they submitted them without checking the packaging marking at all. Now I not only need to solve the current cargo detention problem, but also minimize the loss. How can I avoid such stupid mistakes in future cooperation? I really don't know what kind of freight forwarder can handle these issues reliably!

### Answer 1 — Best Answer

Regarding the port detention problem of precision instruments you encountered，you need to solve the immediate port detention crisis step by step first，then trace the root cause of the problem and establish long-term prevention and control.

Step 1: Handle the cargo detention issue immediately: Contact a qualified agent at the destination port immediately to assist in communication with customs，provide **official identification report confirming the product is non-hazardous** (such as the cargo transportation condition appraisal report issued by a domestic third-party testing institution) and the correct MSDS document，and explain that the wrong packaging marking is caused by factory error，not intentional misdeclaration. If permitted by customs，you can correct the packaging marking on site at the port warehouse (application required in advance)，or entrust the agent to replace with qualified packaging，which can shorten inspection time the fastest.

Step 2: Stop further loss: For container detention charge and storage charge，since the freight forwarder submitted documents without checking the packaging marking in customs declaration materials，which constitutes auditing negligence，you can claim **partial expense compensation** from them in accordance with the entrustment agreement. Meanwhile，inform the client of the problem progress in time，provide customs inspection documents to prove the delay is not intentional on your part，and strive for the client's understanding to waive or reduce compensation.

Tracing the root cause of the problem，this mistake comes from two loopholes: first，marking error in the factory's packaging process，second，negligence in document auditing by the freight forwarder. Long-term prevention and control requires two measures: first，sign a packaging quality agreement with the factory，and require it to attach a **marking checking list** when providing packaging materials，second，when selecting a freight forwarder，focus on examining their document auditing process — whether they have a double checking mechanism (such as a dedicated person responsible for checking the consistency between packaging materials and customs declaration form)，instead of only relying on information provided by the client.

In future cooperation，it is recommended to clearly clarify **responsibility division clauses** with the freight forwarder: if customs clearance abnormality is caused by the freight forwarder's auditing negligence，they shall bear corresponding expenses such as port detention charge and container detention charge，meanwhile，before each shipment，your own team should also conduct a final check on key information in customs declaration materials (such as packaging marking，HS code，cargo value)，to avoid relying solely on the freight forwarder's unilateral check.

### Answer 2

From the perspective of customs declaration, the core issue of this inspection caused by wrong packaging marking is that documents do not match the actual cargo. To solve the current problem, you need to submit a **statement of consistency between cargo and documents** to customs: including the proof of wrong packaging marking issued by the domestic manufacturer, correct cargo description and supervision conditions corresponding to the HS code (confirm that this HS code does not require hazardous cargo declaration). Meanwhile, if the packaging information on the customs declaration form does not match the actual situation, you need to contact the customs broker to apply for **customs declaration form amendment** (if the cargo has not been released yet), or issue a situation statement to the destination port customs. For future prevention, you need to establish a "three-check" mechanism for customs declaration materials: initial check by freight forwarder, recheck by the enterprise, final check by customs broker, focus on checking three key items: HS code, packaging information and cargo value, to avoid big problems caused by small details.

### Answer 3

For the problem of container detention charge and storage charge, you can take the following measures: First, contact the shipping company to apply for **container detention charge reduction or exemption** — provide official proof of customs inspection, explain that cargo detention is caused by unintentional packaging marking error, and shipping companies usually grant partial reduction of detention charge for reasonable reasons. Second, regarding transportation routes, you can choose a freight forwarder that provides "pre-inspection" service for your next shipment, that is, before the cargo departs from the origin port, submit materials through the pre-audit system of the destination port customs to find packaging or document problems in advance. In addition, when selecting a freight forwarder, you need to examine their destination port agent network, whether they have long-term cooperative reliable agents in major ports that can handle sudden inspection problems quickly.

### Answer 4

If this cargo detention leads to delayed delivery of the goods, it may affect the declaration time limit of export tax refund. According to the 2026 export tax refund policy, export enterprises need to declare tax refund within 90 days from the date of customs declaration for export (extension can be applied for special circumstances). If the declaration deadline is exceeded due to cargo detention, you need to submit **customs inspection certificate** and delayed delivery statement to the tax authority, and apply for tax refund extension. In addition, if part of the expenses such as port detention charge is borne by the freight forwarder, this part of income needs to be truthfully recorded in the enterprise income tax declaration to avoid tax risks. It is recommended to clearly specify the expense bearing clause in the agreement signed with the freight forwarder in the future, so that there is a clear basis for tax processing.

### Answer 5

From the perspective of foreign exchange payment and collection, if the client deducts part of the payment due to delayed delivery, you need to explain the situation to the bank when settling foreign exchange, and provide relevant supporting documents (such as client's deduction notice, customs inspection report) to ensure that the settlement data is consistent with the actual transaction. In addition, if the contract amount is changed due to this cargo detention, you need to modify the amount on the commercial invoice and bill of lading in time (if they have not been issued), to avoid the problem of inconsistent amount during foreign exchange payment and collection. In future cooperation, it is recommended to use **CIPS RMB cross-border payment** for settlement, which not only has low exchange rate fluctuation risk, but also improves payment efficiency, especially brings more flexible capital turnover when handling unexpected problems.

### Answer 6

For the loss caused by the freight forwarder's negligence this time, you can claim compensation from the freight forwarder in accordance with the relevant provisions of the entrustment contract in the Civil Code. First, collect evidence: customs declaration materials submitted by the freight forwarder (including wrong packaging marking), customs inspection notice, invoices for container detention charge and storage charge, client's demand letter, etc. Second, if negotiation with the freight forwarder fails, you can complain to the industry association or file a lawsuit. When signing the freight forwarder contract in the future, you need to clearly stipulate the **document auditing responsibility clause**: for example, the freight forwarder shall be responsible for the authenticity and accuracy of the customs declaration materials, for losses caused by auditing negligence, the freight forwarder shall bear XX% of the compensation liability; at the same time, add exceptions to the force majeure clause, and clearly stipulate that human errors such as packaging error do not belong to force majeure.

### Answer 7

Precision optical instruments are fragile products, their packaging not only needs to meet transportation safety requirements, but also needs to avoid marking errors. The root cause of this problem is wrong packaging marking, so you need to establish a packaging quality control process in the future: First, require the packaging manufacturer to provide a **packaging marking confirmation form**, clearly mark the cargo name, HS code, packaging material, weight and other information to ensure it is consistent with the actual situation; second, conduct sampling inspection on the packaging of each batch of goods, focus on checking UN marking (if any), fragile marking, moisture-proof marking, etc.; third, select qualified packaging suppliers, especially for goods exported to the EU, they need to meet the requirements of REACH regulation for packaging materials. In addition, if the cargo has high value, you can purchase **cargo insurance** to transfer risks such as port detention and cargo detention to the insurance company, and reduce the loss of the enterprise.
