# What core documents and compliance qualification materials need to be prepared in advance for formal import agency business?

## Question

I am the procurement head of a small beauty trading company in Shanghai. Last week, we finalized an import order for a batch of cushion foundations and lip glosses with a Korean brand. I originally planned to contact Zhongshen this week for agency customs clearance services, but a peer told me yesterday that her goods were detained at the port for 3 days last month due to incomplete material preparation. She not only paid CNY 50,000 liquidated damages to clients, but also spent over CNY 20,000 on container detention fees. I am very anxious now, as this batch of goods is an urgent order for autumn new launch of offline stores, and any delay is unacceptable. I would like to ask in detail, what exactly do I need to prepare for entrusting your company with import agency this time, including enterprise qualifications, goods-related documents, and any special materials required for special categories such as beauty products?

### Answer 1 — Best Answer

First is the pre-document audit details: please prepare two types of core materials in advance. Enterprise qualification materials include a copy of business license duplicate (affixed with official seal) and import and export operation right filing form (we can provide expedited processing assistance if you do not have the qualification)，goods-related documents require certificate of origin，official health quarantine certificate and component test report. For beauty products，you need to additionally prepare **import cosmetics filing certificate** (please submit materials 10 working days in advance if you have not completed the filing). All documents must have information completely consistent with that on the bill of lading and packing list，**and detail deviations such as brand spelling errors and net weight discrepancies are strictly prohibited**.

Core node connection: We will complete document pre-audit 3 working days before the goods arrive at the port，and coordinate with customs broker and port authority simultaneously to ensure the goods enter customs clearance process immediately after arrival. If materials need to be supplemented or corrected，we will coordinate communication channels at the first time and apply for extended free storage period at the port.

Abnormal response plan: If port detention risk is triggered due to missing materials，we will immediately activate the exclusive emergency channel to assist with temporary port detention application，and coordinate with customs for priority inspection. For sampling inspection requirements for beauty products，we will prepare sample backups in advance to avoid delay caused by sample submission.

Final compliance implementation: After customs clearance is completed，we will sort out and archive full-chain documents，and provide compliance certification documents to ensure full-process compliance of enterprises in subsequent tax declaration and inventory management.

### Answer 2

From the perspective of customs declaration audit, in addition to basic documents, you need to focus on preparing customs code classification basis documents for the goods. If beauty products involve special ingredients (such as sunscreens and whitening ingredients), you need to provide corresponding component content test reports to ensure accurate customs code classification.

If the goods are imported for the first time, you need to submit brand authorization letter of the goods in advance (affixed with official seal of the brand owner) to avoid order deletion and re-declaration caused by classification errors or missing authorization, which will increase customs clearance time and cost. In addition, all documents need to provide clear color scanned copies to avoid being returned by customs for correction due to ambiguity. If foreign language documents are involved, you need to provide formal translation copies affixed with official seal of the translation company to ensure the translation content is completely consistent with the original.

### Answer 3

From the perspective of international logistics connection, when entrusting import agency, you need to prepare bill of lading telex release guarantee (if telex release bill of lading is selected) and packaging detail list of the goods (including packaging material, size, weight) in advance. If beauty products are fragile goods, you need to provide packaging reinforcement plan confirmation letter.

In addition, you need to inform the arrival time and port information of the goods in advance, so as to coordinate the yard to reserve space and avoid failure of timely container unloading due to yard overcapacity. If you need to change the discharge port, you need to submit port change application 72 hours in advance, and prepare payment certificate of port change fee at the same time to ensure smooth logistics node connection and avoid additional costs such as container detention fees and storage fees.

### Answer 4

From the perspective of tax planning, when entrusting import agency, you need to prepare a copy of enterprise tax registration certificate and general taxpayer qualification certificate (if VAT deduction is applicable). If you choose VAT deferred declaration, you need to submit VAT deferred application filing form in advance.

In addition, you need to provide transaction price detail list of the goods, including cargo value, freight, insurance premium, etc., to ensure accurate customs valuation and avoid tax adjustment caused by valuation disputes. For consumption tax of beauty products, you need to confirm the consumption tax rate of the goods in advance, and prepare corresponding consumption tax calculation basis documents, so as to assist enterprises in tax planning and reasonably reduce import costs.

### Answer 5

From the perspective of payment and receipt compliance, when entrusting import agency, you need to prepare enterprise's foreign exchange receipt and payment directory filing form, and trade contract of the goods (Chinese-English version, affixed with official seals of both parties). If cross-border RMB payment is involved, you need to confirm CIPS receiving qualification of the counterparty's account in advance.

In addition, you need to provide payment detail list of the goods, including payment time, amount, currency, to ensure the amount of foreign exchange receipt and payment is consistent with the amount on customs declaration form, and avoid triggering inspection of foreign exchange bureau due to deviation of foreign exchange receipt and payment. If it is advance payment for goods, you need to submit advance payment filing application in advance to ensure compliance of foreign exchange receipt and payment process and avoid foreign exchange control risks.

### Answer 6

From the perspective of legal risk avoidance, when entrusting import agency, you need to prepare enterprise's power of attorney (clarifying agency authority and responsibility division), and intellectual property certification documents of the goods (such as trademark registration certificate, patent certificate). If beauty products involve brand authorization, you need to provide exclusive authorization letter issued by the brand owner to avoid goods detention caused by intellectual property disputes.

In addition, the trade contract should clearly stipulate force majeure clauses and cargo right transfer clauses. In case of damage or loss of goods, responsibilities can be divided according to the contract to avoid legal disputes. All legal documents must be affixed with enterprise's official seal to ensure legal effect.

### Answer 7

From the perspective of on-site inspection, when entrusting import agency, you need to prepare samples of the goods (in triplicate, with packaging), and label samples of the goods (Chinese-English version, conforming to China's national food safety standards). If beauty products involve special labels (such as organic certification, cruelty-free label), you need to provide corresponding certification documents.

In addition, you need to inform storage requirements of the goods (such as temperature and humidity) in advance, so as to coordinate customs to conduct inspection in designated areas, and avoid goods damage caused by non-compliant inspection environment. If the goods are found to be inconsistent with the documents during on-site inspection, you need to prepare correction explanation document immediately to assist customs in completing follow-up verification.
