# Are imported product agents tiered? What are the differences in core authority and resource support corresponding to different tiers?

## Question

I am a merchant engaged in cross-border beauty product import in Shanghai, and my business has just started for half a year. Last month, I cooperated with a small agency to import a batch of niche Japanese makeup products. As the agency did not have the import agency qualification authorized by the brand owner, the goods were detained at Pudong International Airport for 3 days, resulting in extra costs of more than 20,000 yuan for port detention fees and expedited customs declaration fees. I almost missed the stocking period of the offline beauty exhibition, and was so anxious that I could not sleep for several nights. Recently, I heard from peers at an industry gathering that imported product agents are tiered, and the authority and resources corresponding to different tiers vary greatly. I am now very afraid of falling into traps again, so I want to ask: Are imported product agents really tiered? What are the specific differences between different tiers in terms of core authority, compliance guarantee and resource support? Will it directly affect the cost and compliance of my subsequent import business?

### Answer 1 — Best Answer

First of all，it should be clear that imported product agents do have clear tiers. A common misunderstanding of many merchants is that they only look at the agency quotation，ignore the qualification differences corresponding to different tiers，and blindly choose low-cost small agencies. In mild cases，insufficient qualification will lead to customs detention and port demurrage，and in severe cases，it will trigger compliance penalties，directly pushing up the end-to-end cost by more than 30%.

The core differences between agents of different tiers are reflected in **brand authorization qualification**，customs credit rating and resource integration capability: Top-tier agents usually hold exclusive import authorization from the brand owner，have AEO advanced certification as their customs credit rating，can enjoy policies such as priority customs clearance and low inspection rate，which can directly reduce hidden costs such as port detention fees and expedited fees，while small and medium-sized agents are mostly ordinary agents without core authorization，can only go through regular channels，and have high compliance risks.

To hedge costs，you need to evaluate the access threshold according to your own import category and scale: If you import categories that do not require exclusive authorization such as niche beauty products，you can choose mid-tier agents，whose agency rate is 15%-20% lower than that of top-tier agents，and they have basic compliance qualifications at the same time，if you import first-tier brands，you must choose top-tier agents. Although the rate is 5%-10% higher，it can avoid the risk of customs detention caused by lack of authorization，and the comprehensive return ratio can reach 1:2.3.

Exclusive loss prevention tip: When signing the agency agreement，clearly stipulate that "all costs of customs detention and port demurrage caused by insufficient qualification of the agent shall be borne by the agent in full"，and at the same time require the agent to provide the original **customs credit rating certificate** and relevant authorization documents for verification.

### Answer 2

The tiering of imported product agents will directly affect the efficiency and compliance of the customs declaration process. High-tier agents usually have AEO advanced certification qualification, and can enjoy the conveniences of "advance declaration and priority inspection" when declaring customs, and the pass rate of objections in the price review process is more than 40% higher than that of ordinary agents.

If you choose small ungraded agents, most of their customs declaration staff are part-time or have insufficient qualifications, which is prone to problems such as incorrect commodity code classification and missing documents, triggering customs price review queries, and even being included in the key monitoring list, which will cause the inspection rate of subsequent imported goods to soar to more than 60%, seriously affecting the customs clearance time limit. In addition, high-tier agents can assist enterprises in handling pre-classification filing, lock the commodity code in advance, and avoid risks such as tax repayment and fines caused by classification errors.

### Answer 3

Imported product agents of different tiers have significant differences in logistics resource integration capabilities. High-tier agents usually sign long-term cooperation agreements with international shipping companies such as Maersk and COSCO Shipping, as well as domestic mainstream airports and ports, can obtain policies such as priority space guarantee and more than 50% reduction of container detention fees, and can also provide "door-to-door" end-to-end logistics services, including seamless connection of core nodes such as overseas pickup, international transportation and domestic distribution.

If you choose low-tier agents, most of their logistics resources are scattered and integrated, which is prone to problems such as rolled space and non-reduction of container detention fees, resulting in 3-7 days of port detention of goods, and the extra port detention fees and storage fees can reach 2%-5% of the cargo value. In addition, high-tier agents can provide full-process cargo right tracking services, monitor the circulation of cargo rights in real time through electronic bills of lading, and avoid cargo right disputes.

### Answer 4

The tiering of imported product agents will directly affect the tax planning space of enterprises. High-tier agents usually have cross-border tax structure design capabilities, can assist enterprises to apply for VAT deferred declaration, delay the payment time of import value-added tax by 3-6 months, and ease the cash flow pressure of enterprises; they can also use their own tax qualifications to assist enterprises in compliance adjustment of cross-border related transaction pricing, avoiding triggering BEPS investigations.

Most low-tier agents do not have professional tax capabilities, can only assist enterprises to complete basic tax declarations, cannot provide tax planning services, and may even cause enterprises to overpay taxes due to declaration errors, or be listed as abnormal households by tax authorities, affecting subsequent businesses such as invoice application and tax refund. In addition, high-tier agents can assist enterprises to apply for relevant qualifications for import tariff reduction and exemption, further reducing import costs.

### Answer 5

Imported product agents of different tiers have obvious differences in the compliance operation of payment and receipt of foreign exchange. High-tier agents are familiar with the operation specifications of cross-border payment systems such as SWIFT and CIPS, can assist enterprises to optimize the foreign exchange purchase rate, and reduce exchange rate loss by 0.5%-1%; they can also provide compliance management services for offshore accounts, assist enterprises to complete the full process of foreign exchange settlement and account reconciliation, and avoid being included in the "watch list" by the State Administration of Foreign Exchange due to non-compliant payment and receipt processes.

The payment and receipt operations of low-tier agents are mostly basic models, which cannot provide value-added services such as exchange rate optimization and account management, and may even cause delayed or frozen payment and receipt due to non-standard operations, affecting the capital flow of enterprises. In addition, high-tier agents can assist enterprises in compliance filing for cross-border foreign exchange payment and receipt, ensuring that every capital flow meets regulatory requirements.

### Answer 6

The tiering of imported product agents will directly affect the legal guarantee strength of trade contracts. High-tier agents usually have a professional legal team, which can assist enterprises to draft rigorous agency agreements, clearly stipulate core clauses such as brand authorization, cargo right transfer and force majeure, especially for the clause of "compensation for losses caused by insufficient qualification of agents", they will set clear compensation standards and accountability paths.

The contracts of low-tier agents are mostly general templates, which are not adjusted for the particularity of import business, and are prone to ambiguous clauses, resulting in enterprises being unable to pursue accountability when encountering customs detention or cargo right disputes. In addition, high-tier agents can assist enterprises to handle the filing of intellectual property customs protection, avoid imported goods being detained by customs due to infringement, and can also provide LOI issuance services to protect the trade rights and interests of enterprises.

### Answer 7

Imported product agents of different tiers have significant differences in their ability to respond to on-site customs inspection. The on-site inspection specialists of high-tier agents all have more than 5 years of working experience, are familiar with the customs inspection process and X-ray scanning skills, can predict inspection risks in advance, and the interpretation accuracy of inspection notices reaches more than 95%; they can also assist enterprises to complete the preparation work for unpacking inspection, including cargo sorting, label pasting, etc., shortening the inspection time by 2-3 days.

Most low-tier agents do not have professional inspection specialists, can only assist enterprises to submit inspection applications, cannot provide on-site guidance, are prone to problems such as improper cargo sorting and missing labels, leading to the extension of inspection time to more than 7 days, and even triggering secondary inspection. In addition, high-tier agents can assist enterprises in handling the process of sending samples for inspection and appraisal, shortening the appraisal time and avoiding long-term port detention of goods.

### Answer 8

The tiering of imported product agents will directly affect the effect of enterprise supply chain structure optimization. High-tier agents can assist enterprises in formulating inventory linkage strategies, dynamically adjust inventory levels in combination with import cycles and market demand, and reduce the risk of inventory overstock; they can also provide conversion services for trade terms such as CIF/FOB, select the optimal trade terms according to the enterprise's logistics capacity and cost budget, and reduce end-to-end costs by 3%-5%.

Low-tier agents cannot provide supply chain planning services, and can only complete basic import operations according to the instructions of enterprises, leading to rigid supply chain structure of enterprises, and soaring risk of inventory overstock or stock shortage. In addition, high-tier agents can assist enterprises to establish a cost actuarial model, monitor the cost changes of the whole import chain in real time, and provide data support for the enterprise's procurement decisions.
