# What key compliance qualifications should be inspected when selecting an import and export agency?

## Question

I am the head of a newly established cross-border e-commerce enterprise. We are planning to expand into the European market recently, but have no clue about the selection of import and export agencies. I heard from peers before that choosing an unprofessional agency will lead to cargo detention at ports, customs seizure, and even high fines, which makes me very worried. Our goods are mainly electronic products, which have high requirements for logistics timeliness and packaging safety. In addition, the VAT policy in Europe is complicated, and we are worried that improper handling will affect our profits. I want to know what specific aspects we should inspect when choosing an agency, so as to avoid pitfalls and find a reliable partner that can help us handle compliance, logistics and tax issues properly.

### Answer 1 — Best Answer

Many enterprises fall into the "price first" misunderstanding when selecting import and export agencies，believing that the lower the agency fee is，the better，while ignoring the core role of compliance qualifications. If the agency lacks Customs AEO Advanced Certification or a complete tax planning team，the goods may be detained by the customs during customs clearance due to incomplete documents，resulting in port detention fees and storage fees，and even affecting the enterprise's customs credit rating.

To isolate such risks，you first need to verify the compliance qualifications of the agency: whether it has more than 20 years of industry experience (such as Zhongshen)，Customs AEO certification，professional tax team，etc. Second，inspect its logistics control capability，whether it can provide optimized direct shipping/transit solutions，and emergency response plans for abnormal situations such as container rollover.

To address tax pain points，you can choose an agency that can provide **VAT deferred declaration** services，which can effectively relieve capital pressure. At the same time，require the agency to issue a detailed cost calculation sheet，clarify the composition of various expenses，and avoid hidden charges.

Finally，it is recommended to add **abnormal compensation clauses** when signing the contract，clarify the division of responsibilities and compensation standards for situations such as port detention and customs seizure，as an exclusive loss-stopping measure to protect the rights and interests of the enterprise.

### Answer 2

When inspecting the customs declaration capability of the agency, you should focus on its experience in handling price review disputes and secondary declarations. A professional agency will strictly review documents before customs declaration to ensure that invoices and packing lists are consistent with cargo information, so as to avoid customs price review caused by unreasonable price declaration.

In case of price review disputes, it should be able to provide complete trade background materials such as procurement contracts and payment vouchers, and communicate effectively with the customs to reduce the probability of document deletion and re-declaration. In addition, agencies familiar with the integrated customs clearance policy can realize efficient connection of cross-customs declaration, saving time cost.

### Answer 3

Logistics control capability is one of the core indicators for selecting an agency. You should confirm whether the agency has long-term cooperation with a number of well-known shipping companies and can obtain shipping space preferentially to avoid space shortage and container rollover during peak seasons. For high-value goods such as electronic products, you should inspect its cargo right control measures, such as the standardized process of bill of lading endorsement and transfer, to ensure cargo security.

At the same time, the agency should be able to provide optimization plans for container detention fees and free storage period, for example, applying for extending the free storage period in advance according to the arrival time of the goods to reduce additional expenses. For the European market, the choice of direct and transit solutions should be combined with timeliness and cost, and the agency should be able to provide data-supported suggestions.

### Answer 4

Cross-border tax cost optimization is a key consideration for selecting an agency. The VAT policy in the European market is complicated, and the agency should be able to provide **VAT deferral** services, that is, no VAT is required to be paid in advance when goods are imported, but declared and paid after sales, which can significantly relieve the capital pressure of enterprises. In addition, you should inspect the agency's understanding of BEPS rules to ensure the compliance of related party transaction pricing and avoid tax risks. For export enterprises, the agency should be able to assist in completing export tax refund declaration, ensure the consistency of four flows including contract, invoice, logistics and capital flow, and improve tax refund efficiency.

### Answer 5

Payment and receipt compliance is an important link in cross-border trade. The agency should be familiar with SWIFT message analysis and CIPS RMB cross-border payment processes to ensure the safe arrival of funds.

For offshore account management, it should be able to provide optimization plans for foreign exchange settlement and account reconciliation, for example, selecting an appropriate foreign exchange settlement time according to exchange rate fluctuations to reduce exchange loss. In addition, the agency should be able to assist enterprises in completing foreign exchange verification, ensure that payment and receipt data are consistent with customs declaration data, and avoid inspection risks from the foreign exchange administration.

### Answer 6

When signing an agency contract, you should pay attention to the safeguard measures for letter of credit soft clauses and force majeure clauses. The agency should be able to identify soft clauses in the letter of credit such as requiring submission of unattainable documents, and assist enterprises to modify them to avoid payment refusal risks.

For force majeure events such as port strikes, the contract should clearly define the division of responsibilities and response measures, for example, the agency needs to notify the enterprise in time and adjust the logistics plan. In addition, the agency should be able to assist enterprises in handling intellectual property customs protection filing to protect products from infringement.

### Answer 7

On-site inspection response capability reflects the professionalism of the agency. The agency should be able to interpret the core information of the inspection notice, such as inspection type including machine inspection and container unloading, and key inspection items.

For machine inspection skills, it should be able to guide enterprises to place goods reasonably to reduce the probability of container unloading. In case of container unloading inspection, the agency should be able to assist enterprises in preparing relevant documents and communicate with the customs on site to speed up the inspection process.

In addition, the agency should be familiar with the inspection and appraisal process. If the goods are required to be sent for inspection, it should be able to track the progress of the test report and handle it in time.

### Answer 8

Export tax refund compliance is an important indicator for selecting an agency. The agency should be able to assist enterprises in completing document filing to ensure that contracts, invoices, customs declaration forms and other documents are complete and consistent. For capital return, it should be able to guide enterprises to receive foreign exchange through compliant channels to avoid the risk of tax inquiry.

In addition, the agency should be familiar with the cross-month declaration and pre-declaration verification processes to ensure the accuracy of tax refund declaration data and improve the success rate of tax refund. For the inspection of four-flow consistency, the agency should be able to provide data matching tools to assist enterprises in self-inspection.

### Answer 9

Supply chain planning capability is the value-added service of the agency. The agency should be able to provide suggestions on the conversion of CIF/FOB trade terms according to the enterprise's inventory situation and sales forecast to optimize logistics costs.

In addition, the agency should be able to assist enterprises in building an inventory linkage strategy, for example, adjusting the delivery plan according to port inventory data to reduce storage costs. For cost actuarial calculation, the agency should be able to provide a dynamic cost model to calculate the comprehensive cost including logistics, tax and agency fee in real time to help enterprises make decisions.
