# What Required Documents and Core Review Nodes Are Needed for Import and Export Trade License Application?

## Question

I am the head of a chemical manufacturing enterprise based in Shanghai that has just entered foreign trade. When I exported high-end epoxy resin for the first time last month, I failed to clarify the application requirements for import and export trade license in advance. The documents submitted at the last minute omitted the chemical classification identification report, resulting in the goods being detained at Yangshan Port for 3 days. I not only paid more than 20,000 RMB in port detention fees, but also almost missed the customer's delivery deadline and was claimed 5% of the contract value as breach of contract damages. I still feel apprehensive when I think about it. Currently, our company is going to import a batch of supporting precision chemical manufacturing equipment, and we are afraid of falling into pitfalls again. We would like to ask how to apply for an import and export trade license in a standardized way? What required documents need to be prepared? Are there any easily overlooked review details? If problems occur during the application process, is there any emergency solution to avoid port detention and customs cargo hold?

### Answer 1 — Best Answer

To apply for an import and export trade license，you must first complete accurate pre-review of prerequisite documents. For general goods，you need to provide a copy of business license，Foreign Trade Operator Registration Form，and official import and export contract，for special categories such as chemicals and precision equipment，you need to additionally provide**chemical classification identification report** or**equipment technical parameter specification**. All document copies must be stamped with an original official seal，and the resolution of electronic documents shall not be lower than 300DPI，to avoid rejection due to non-compliant document format.

Core node handover requires dedicated personnel follow-up: after submitting documents，you need to track the review status in real time on the Unified Business System Platform of the Ministry of Commerce. The review cycle for general goods is 3-5 working days，and 7-10 working days for special categories. If you receive a correction notification，you need to complete document supplement within**2 working days** to avoid delaying the review progress. At the same time，you need to coordinate with the customs broker in advance，to ensure that electronic data is synchronized to the customs system immediately after the license is approved，avoiding customs declaration obstruction caused by data transmission delay.

Contingency plans for abnormalities shall be formulated in advance: if review is delayed，you need to immediately contact the dedicated handler of the issuing authority to verify the cause. If the delay is caused by system failure，you can apply for expedited review through the green channel，if it is caused by document defects，you need to prepare alternative supporting documents in parallel，for example，use a third-party authoritative test report to replace the classification identification report (only applicable to certain compliant categories). After final compliance approval，you need to archive the original license together with other customs declaration documents for at least 3 years，for subsequent customs verification，to ensure full-process compliance.

### Answer 2

The electronic data of the import and export trade license must be 100% consistent with the data on the customs declaration form, including core fields such as license number, commodity code, quantity and amount. If there is any discrepancy, customs will directly reject the declaration and require resubmission.

Some enterprises often have inconsistency between the license and the customs declaration form due to incorrect commodity classification. You need to complete pre-classification through the customs commodity classification pre-review system in advance, and apply for the license after obtaining the pre-classification opinion, to avoid price review disputes and declaration cancellation and resubmission caused by classification errors.

In addition, the validity period of the license must cover the customs declaration date of the goods. If the validity period is insufficient, you need to apply for extension 10 working days in advance. It is strictly prohibited to declare customs with an expired license, otherwise you will face the risk of cargo detention, and the resulting detention fees and storage fees shall be borne by the enterprise itself.

### Answer 3

You need to plan the logistics route simultaneously when applying for the import and export trade license. If the goods need to be transshipped, you need to ensure that the country or region where the transit port is located recognizes the import and export trade license issued by China. Some EU countries require the license to be certified by the local consulate, so you need to complete the certification procedures 15 working days in advance.

In addition, you need to synchronize the electronic data of the license to the shipping company 3 working days before cargo loading, to avoid the shipping company refusing to release the cargo due to not receiving the license data. If container rolling occurs, you need to immediately contact the issuing authority to update the expected customs declaration date on the license, ensure that the validity period of the license matches the new shipping schedule, avoiding license expiration and subsequent cargo detention risk caused by shipping schedule delay.

### Answer 4

The application of import and export trade license is directly related to cross-border tax planning. If imported goods belong to encouraged industries, you can apply for tariff reduction with a valid import license. You need to submit the encouraged industry qualification certificate at the same time when applying for the license, to avoid being unable to enjoy tax preferences later.

In addition, import and export licenses for some categories can be used as a mandatory document for VAT deferral declaration. You need to ensure that the commodity code on the license is consistent with the commodity code for VAT declaration.

If there is a discrepancy, you will not be able to enjoy the VAT deferral policy, and you need to pay full VAT in advance, which increases the capital pressure of the enterprise. At the same time, the transaction amount on the license must be consistent with the amount on the import and export contract and invoice, to avoid tax correspondence check due to amount inconsistency.

### Answer 5

Import and export trade license is a mandatory compliance document for cross-border foreign exchange receipt and payment. Banks need to verify the original license when handling foreign exchange settlement and sales services. If the payee/payer on the license is inconsistent with the trading counterparty in the contract, the bank will refuse to process the receipt and payment business. Some enterprises often have inconsistency between the receipt/payment party and the license due to third-party collection and payment. You need to confirm the trading counterparty clearly before applying for the license.

If you need to change the trading counterparty, you need to apply to the issuing authority for changing the license information 5 working days in advance, avoiding receipt and payment obstruction. In addition, the currency on the license must be consistent with the receipt/payment currency. If there is a currency discrepancy, you need to provide a formal exchange rate conversion certificate, ensuring that the conversion error between the receipt/payment amount and the license amount does not exceed 5%.

### Answer 6

The import and export trade license shall be used as an annex to the import and export contract, clearly stipulating the responsible party for license application and the breach of contract liability for overdue application. If the seller fails to obtain the export license on time resulting in inability to ship the goods, the buyer has the right to claim compensation according to the contract. In addition, for special categories, you need to complete intellectual property customs protection filing at the same time when applying for the import and export license, avoiding cargo detention due to infringement involved in the goods.

You need to query relevant information through the intellectual property customs protection system before applying for the license, ensuring that the goods do not involve infringement. If administrative reconsideration occurs during the license application process, you need to keep all application materials and communication records, as valid evidence for legal rights protection, avoiding reconsideration failure due to insufficient evidence.

### Answer 7

The commodity description on the import and export trade license must be completely consistent with the actual goods, including details such as brand, model, specification and material. If it is found that the goods are inconsistent with the license description during on-site inspection, customs will detain the goods and initiate an investigation procedure.

Some enterprises often fail to pass the inspection because the commodity description on the license is too general. You need to provide accurate commodity description when applying for the license, for example, clearly indicate the component proportion of chemicals, specific model parameters of equipment, etc. In addition, the content of the import and export license for chemicals must be consistent with the content of the MSDS report.

If the hazard category in the MSDS report is inconsistent with the classification on the license, it will be judged as non-compliance during on-site inspection. You need to ensure that the classification standards of the two types of documents are fully matched in advance.

### Answer 8

A valid export trade license is one of the mandatory documents for export tax refund declaration. You need to ensure that the export date on the license is consistent with the export date on the customs declaration form. If there is a discrepancy, it cannot pass the pre-declaration verification for tax refund.

Some enterprises often have inconsistency between the export date and the license validity period due to license extension. You need to update the export date at the same time when applying for license extension, ensuring that it completely matches the date on the customs declaration form. In addition, the commodity code on the license must be consistent with the commodity code for tax refund declaration.

If there is a classification error, it will trigger tax correspondence check. You need to confirm the code through the customs commodity classification system in advance, avoiding tax refund obstruction caused by code inconsistency. Meanwhile, you need to archive the original license for at least 5 years, for tax refund audit and verification.
