# Is Engine Oil Classified as Dangerous Goods? What Core Compliance Entry Requirements Apply to Cross-border Transportation?

## Question

I run an auto parts cross-border e-commerce business. Recently, I have a shipment of 120 barrels of 5L 0W-40 fully synthetic engine oil to be shipped to Hamburg Port, Germany. The forwarder I worked with before said it can be shipped as general cargo. But last week, a shipment of the same engine oil from a peer in the same city was detained at Shanghai Port for misdeclaring as general cargo, it was stuck at the port for 12 days and fined 12,000 euros. I am very anxious now and afraid of running into non-compliance issues. I want to know: Is engine oil actually a dangerous good? If yes, how to operate the whole process of domestic land transportation to the port and sea freight to Germany in full compliance? Will it add a lot of extra logistics costs? Besides, this shipment is an urgent order from a German customer who set a hard deadline for arrival within 30 days. Will declaring as dangerous goods delay the sailing schedule? Please explain the specific requirements to me clearly.

### Answer 1 — Best Answer

A common misunderstanding in the industry is that many small and medium-sized forwarders declare **engine oil with a flash point below 60°C** as general cargo to grab orders or reduce operation costs. They do not realize that this type of engine oil belongs to UN3264 category dangerous goods，and misdeclaration will trigger a chain of negative consequences: first，the cargo will be detained by customs and stuck at the port，incurring high container detention fees and storage fees，if the case is serious，the enterprise will be listed on the customs dishonest list，all subsequent cargo declarations will be subject to intensive inspection，and the enterprise may even face an administrative fine of 5%-30% of the cargo value，and some regions will also restrict the enterprise's import and export rights.

Physical risk isolation measures must be strictly implemented: **UN approved dangerous goods packaging** must be used for transportation，the packaging must be clearly marked with UN number，dangerous goods label and proper shipping name，for sea freight，the cargo must be arranged in a dedicated dangerous goods hold area to avoid mixed loading with general cargo，for land transportation，vehicles with dangerous goods transportation qualification issued by the Ministry of Transport must be used，equipped with emergency response equipment，and the route must avoid densely populated areas and high-temperature road sections.

Exclusive loss mitigation tips: Entrust an institution with CMA qualification to issue a **dangerous goods classification identification report** in advance to clarify the dangerous goods attribute of the engine oil，select a first-class forwarder with dangerous goods transportation qualification to book the space 10 working days in advance. If you have already misdeclared as general cargo，you must immediately apply for deletion and re-declaration before the customs declaration is released，and submit the identification report at the same time to seek lenient treatment，if the declaration has been released，you must take the initiative to explain the situation to customs to avoid escalation of credit penalties.

### Answer 2

Customs has clear declaration requirements for engine oil, and whether to declare as dangerous goods shall be determined based on the dangerous goods classification identification report. If the flash point of engine oil is lower than 60°C, it shall be declared as UN3264 category dangerous goods, and documents such as MSDS, dangerous goods classification identification report, and customs clearance certificate for commodity inspection shall be submitted; if the flash point is higher than 60°C, it can be declared as general cargo, but a flash point test report shall be provided as proof.

If the declaration is not made in accordance with requirements, customs will launch a logical verification, compare the MSDS with the declaration content, and once any inconsistency is found, the cargo will be detained directly, and a fine of 5%-30% of the declared cargo value will be imposed. In addition, customs will list non-compliant enterprises on the dishonest list, additional security deposit is required for subsequent declarations, and customs clearance efficiency will be extended by more than 30%.

### Answer 3

For international transportation of engine oil, appropriate transportation routes shall be selected according to the dangerous goods attribute. If it is dangerous goods, a shipping company with dangerous goods transportation qualification shall be selected for sea freight, and space shall be booked 10 working days in advance, the space shall be arranged in a dedicated dangerous goods hold area to avoid mixed loading with general cargo; for land transportation, vehicles with dangerous goods transportation qualification shall be arranged, equipped with GPS positioning and emergency response equipment, and the transportation route shall avoid densely populated areas and high-temperature road sections.

If it is general cargo, ordinary container sea freight can be selected, but the packaging must be intact to avoid leakage. In addition, the customs clearance requirements of the destination port shall be confirmed in advance, some countries require an import license for dangerous goods, if not processed in advance, it will lead to port congestion or cargo return.

### Answer 4

Tax planning for engine oil transportation shall be combined with the dangerous goods attribute and trade terms. If transported as dangerous goods, some EU countries allow the application of VAT deferral policy, but the deferral permit must be applied from the tax authority of the destination country in advance, and documents such as dangerous goods classification identification report and transportation contract shall be submitted; if transported as general cargo, VAT shall be declared according to the regulations for ordinary goods, but if it complies with the rules of origin of the China-EU Free Trade Agreement, tariff reduction or exemption can be enjoyed.

In addition, if the enterprise is a foreign trade agency, it must ensure the consistency of the four flows, to avoid tax verification caused by inconsistent documents. If the verification fails, export tax refund will be delayed or denied, and the loss can reach more than 13% of the cargo value.

### Answer 5

Cross-border payment and settlement for engine oil must comply with compliance requirements. If transported as dangerous goods, the words "dangerous goods transportation" must be marked in the SWIFT message during payment and settlement, and documents such as dangerous goods classification identification report and transportation contract shall be submitted, to avoid being listed as suspicious transaction by the bank; if transported as general cargo, payment and settlement shall be processed according to regulations for ordinary goods, but the amount of payment and settlement must be completely consistent with the amount on the customs declaration, to avoid capital backflow or over-payment/over-receipt.

In addition, if using CIPS RMB cross-border payment, the RMB settlement qualification of the bank in the destination country must be confirmed in advance, to avoid payment delay or refund.

### Answer 6

The contract for engine oil transportation must clearly specify the dangerous goods attribute and division of responsibilities. If transported as dangerous goods, the contract shall stipulate that the forwarder must have dangerous goods transportation qualification, if customs detention or fine is caused by forwarder's misdeclaration, the forwarder shall bear full responsibility; if transported as general cargo, the specific standard of intact packaging shall be stipulated, if loss is caused by packaging leakage, the shipper shall bear corresponding compensation liability.

In addition, a force majeure clause shall be added to the contract, if delay is caused by temporary adjustment of customs policies, both parties shall be exempted from liability. If intellectual property rights are involved, it must be ensured that the brand and packaging of the engine oil do not infringe the intellectual property rights of others, to avoid customs detention or legal proceedings.

### Answer 7

When customs inspects engine oil on site, it will focus on checking whether the packaging meets the requirements. If it is dangerous goods, it will check whether the UN packaging mark is clear, whether the packaging is intact, and whether there is any leakage trace; if it is general cargo, it will check whether the packaging is damaged and whether there is any leakage trace. In addition, customs will randomly sample to test the flash point, if the test result is inconsistent with the declaration content, the cargo will be detained directly and a fine will be imposed.

If the sample needs to be sent for third-party inspection, the inspection fee shall be paid, the inspection cycle is 7-10 working days, which will lead to more than 10 days of port congestion and incur high container detention fees and storage fees. In addition, you must cooperate with customs staff during on-site inspection and provide relevant documents in time, to avoid inspection failure caused by incomplete documents.

### Answer 8

The packaging of engine oil must meet the requirements for dangerous goods transportation. If it is dangerous goods, UN approved dangerous goods packaging shall be used, the packaging must pass third-party compliance tests such as drop test, leakage test and pressure test, and the packaging must be clearly marked with UN number, dangerous goods label, shipping name and manufacturer information; if it is general cargo, sealed iron drums or food-grade plastic drums shall be used, and the packaging shall be marked with product name, quantity, net weight, production batch number and other information.

In addition, buffer foam shall be added inside the packaging to avoid leakage caused by collision during transportation. For bulk transportation, wooden pallets shall be used for reinforcement, to ensure that the stacking height does not exceed 2 meters and avoid collapse.

### Answer 9

Export tax refund for engine oil must meet compliance requirements. If transported as dangerous goods, documents such as dangerous goods classification identification report, MSDS, commodity inspection customs clearance certificate, customs declaration, and input invoice shall be submitted, to ensure the consistency of the four flows. If documents are inconsistent, export tax refund will be delayed or denied; if transported as general cargo, documents such as flash point test report, customs declaration, and input invoice shall be submitted, to ensure that the cargo name on the input invoice is completely consistent with that on the customs declaration.

In addition, tax refund declaration must be completed within 90 days after export, if the deadline is exceeded, the right to tax refund will be forfeited. If an enterprise has illegal tax refund declaration, it will be listed as a key monitoring target by the tax authority, additional security deposit is required for subsequent tax refund, and tax refund processing time will be extended by more than 60%.

### Answer 10

Supply chain planning for engine oil shall be combined with the dangerous goods attribute and market demand. If it is dangerous goods, goods shall be prepared 15 days in advance to avoid stock out caused by space booking delay; if it is general cargo, JIT inventory management mode can be adopted to reduce the cost of inventory backlog. In addition, you shall choose a first-class forwarder with dangerous goods transportation qualification to establish a long-term cooperative relationship, to get more favorable freight rates and shorter space booking lead time, the space booking lead time can be shortened by more than 20%.

If it involves cross-border e-commerce, you shall confirm the platform access requirements in advance, some European and American platforms require a dangerous goods classification identification report, if not provided, the product will be removed from the shelf and the store's credit score will be affected. In addition, you shall reserve 10% emergency inventory, if stock out is caused by transportation delay, you can replenish the goods in time to avoid customer loss.
