# What Are the Compliance Nodes and Core Operation Details in the Full Process of Machine Export Customs Declaration?

## Question

I am the foreign trade manager of a small CNC lathe manufacturing enterprise based in Shanghai. This is our first time exporting two heavy-duty CNC lathes to the Port of Hamburg, Germany. The freight forwarder we cooperated with before only mentioned customs declaration in general terms, and did not explain specific document requirements and process details. Now the goods have been delivered to the warehouse of Lingang Free Trade Zone, and container loading and shipment will be arranged next week. I am very worried that incorrect document filling, wrong classification or process connection error will lead to cargo detention by customs, which will not only require me to pay the overdue penalty to the customer, but also bear high container detention fees and yard storage fees. I want to know starting from now, how can I complete customs declaration in compliance step by step, what key nodes should I focus on, and what emergency solutions are available if any abnormality occurs?

### Answer 1 — Best Answer

First of all，pre-document review details: Be sure to complete document pre-audit 72 hours in advance，focus on checking whetherHS code classification of the machine，certificate of origin，customs clearance certificate for commodity inspection (if required)，and the weight/size in the packing list are consistent with the actual goods. In particular，the nameplate parameters of the heavy-duty lathe must completely match the customs declaration form，to avoid triggering customs price assessment or inspection due to incorrect classification or inconsistent documents.

In terms of core node connection: Complete customs declaration documents should be submitted to the customs broker 24 hours before container loading，and simultaneously confirm that the bill of lading number and container number on the manifest information are consistent with those on the customs declaration form，immediately take photos of the cargo fixing inside the container and photos of the seal number for retention after container loading，to ensure the consistency of cargo title and customs declaration information.

Contingency plans should be formulated in advance: If customs inspection is encountered，provide the original manufacturer's instruction and technical parameter sheet immediately to assist customs price assessment，if there is document omission，we can assist to complete deletion and re-declaration within 4 hours to avoid cargo detention at port，if customs detention is caused by HS code dispute，the pre-classification opinion appeal channel can be activated.

Final compliance implementation: After customs clearance and release，obtain the tax refund copy of the customs declaration and release notice in time，complete document filing simultaneously，to ensure the compliance of subsequent export tax refund and payment and collection of foreign exchange.

### Answer 2

When conducting machine export customs declaration, a common misunderstanding is that enterprises classify HS code only based on experience, instead of based on the specific provisions of the Harmonized Commodity Description and Coding System by customs. Incorrect classification will trigger customs price assessment disputes, it only requires tax supplementary payment in minor cases, but directly leads to customs detention, cargo congestion at port, and generates hundreds of dollars of container detention fee and yard storage fee per day in serious cases.

The effective pre-risk control measure is to apply for a pre-classification opinion from the customs in advance to shift the classification risk forward; the exclusive loss control tip is that if the classification error has already occurred, you can submit a classification review application to the customs with the original manufacturer's technical instruction of the machine, and strive to complete the correction within 3 working days to avoid long-term customs detention.

### Answer 3

Machine export customs declaration needs to be closely connected with logistics nodes. Before container loading, confirm the free storage period and the starting date of container detention fee of the port. Especially, the loading time of heavy machinery is relatively long, you need to apply for a 1-2 day extension of free storage period from the shipping company in advance, to avoid container detention fee caused by loading delay.

If the shipping company rolls the container, you need to switch to another sailing on the same route immediately, and update the bill of lading number information on the customs declaration form simultaneously to ensure that the customs declaration information is consistent with the manifest; if port change is required, complete the customs declaration modification application 48 hours before the cargo departs, to avoid high transfer costs after the cargo arrives at the wrong port.

### Answer 4

Under the traditional mode of machine export customs declaration, enterprises need to pay value-added tax first and then apply for tax refund, which occupies a large amount of cash flow. The optimization path is to apply for VAT deferral, that is, enterprises do not need to pay VAT at the time of export, and directly offset after completing the tax refund declaration subsequently, which can save at least 30 days of cash flow occupation cost.

The access threshold is that the enterprise needs to have general taxpayer qualification, and the goods meet the requirements of export tax refund; in terms of benefit ratio calculation, for a machine worth 1 million RMB, VAT deferral can save 130,000 RMB of immediate cash flow, calculated based on an annualized 5% capital cost, it can save about 1083 RMB of capital occupation cost.

### Answer 5

The payment and collection of foreign exchange after machine export customs declaration needs to comply with compliance requirements. When receiving payment from overseas customers, ensure that the transaction remark in the SWIFT message is consistent with the cargo name and amount on the customs declaration form, to avoid triggering verification by the State Administration of Foreign Exchange due to vague transaction remark.

If you use CIPS RMB cross-border payment, you need to clearly mark "payment for exported CNC lathes" in the message, and keep documents such as customs declaration, contract, invoice for future reference; if there is a settlement difference in foreign exchange collection, submit a difference explanation to the State Administration of Foreign Exchange in time, to avoid the account being restricted from payment and collection functions.

### Answer 6

When conducting machine export customs declaration, ensure that the intellectual property clause in the trade contract is consistent with the customs record. If the machine involves patented technology, you need to apply for intellectual property customs protection record to the customs in advance, to avoid the cargo being seized due to suspected infringement.

If you use letter of credit settlement, you need to review the soft clauses in the letter of credit, such as "customs declaration can only be made after the buyer issues the inspection qualification certificate". Such clauses will make enterprises unable to independently control the customs declaration progress, you need to negotiate with the buyer to modify it to "provide qualification certificate issued by a third-party inspection institution", to avoid customs declaration delay caused by buyer's delay.

### Answer 7

When machine export customs declaration encounters customs inspection, prepare the original manufacturer's instruction, technical parameter sheet, nameplate photos and other materials in advance to assist the customs to complete the inspection.

If the customs requires unpacking inspection, ensure that the packaging of the machine meets the transportation requirements, to avoid cargo damage during unpacking; if there is an image abnormality in machine scanning inspection, take the initiative to explain the internal structure of the machine to the customs, to avoid the customs judging it as suspected contraband. After the inspection is completed, check the customs inspection record to ensure that the cargo information in the record is consistent with the customs declaration form, to avoid the problem of inconsistent customs declaration data in the future.

### Answer 8

After the completion of machine export customs declaration, ensure the consistency of four flows, that is, the information of contract flow, capital flow, goods flow and invoice flow completely match. If the four flows are inconsistent, it will trigger tax verification, leading to delay or even inability of export tax refund.

During pre-declaration verification, focus on checking whether the export date, cargo name and amount on the customs declaration form are consistent with the information on the VAT invoice; during foreign exchange collection verification, complete foreign exchange collection within 90 days after customs release, if you cannot collect foreign exchange on time due to special circumstances, submit an application for deferred foreign exchange collection to the tax authority, to avoid affecting the processing of export tax refund.
