# What is the standard warranty period of export shipping agent containers? What core service scopes does it cover?

## Question

I am a foreign trade manager of a Shanghai-based enterprise mainly engaged in the export of precision optical instruments. Last week, I shipped a 20GP full container load via Zhongshen to Hamburg, Germany. The value of this shipment is nearly 800,000 RMB, and all cargo are high-precision lenses with extremely high requirements for storage environment. I am very worried now -- I didn't pay much attention to the details of container warranty when signing the agency contract before, and I am afraid that problems such as rain leakage, deformation and refrigeration failure will occur to the container during transportation and damage the cargo. I would like to consult, how long is the warranty of your export shipping agent container? Will there be any difference because we chose FCL instead of LCL? Can we apply for extended warranty in advance if there are potential minor defects of the container before the warranty expires? A peer of mine got no compensation for container sealing failure, lost more than 100,000 RMB and lost a client. I am very anxious now and afraid of falling into common industry pitfalls.

### Answer 1 — Best Answer

First of all，we need to point out a common industry misunderstanding: most export enterprises mistakenly believe that agent container warranty is "full coverage from container stuffing to cargo delivery"，but in fact the default industry rule is "from container stuffing and departure to 30 days after vessel sailing"，which only covers structural defects of the container itself (such as sealing failure，frame deformation，refrigeration system failure of reefer containers)，and does not cover indirect losses caused by cargo damage.

If you fall into this misunderstanding，a series of negative consequences will follow: if the container has defects such as rain leakage and deformation after arrival at the port，the enterprise cannot apply for compensation because the warranty has expired. The enterprise will not only bear the direct cost of repairing or remanufacturing the goods，but also may face high compensation claims from customers due to delivery delay，and even have to pay port congestion fees and storage fees. A single loss can reach 15%-30% of the cargo value，and in severe cases，long-term cooperative overseas customers will be lost.

Physical risk isolation measures must be implemented in advance: before container stuffing，you must require the agent to provide the latest inspection report of the container，take photos and keep evidence of the door seal strip，floor flatness，and refrigeration system (if applicable) one by one，and arrange loading after confirming that the container meets international maritime safety standards，so as to avoid potential risks from the source.

**Exclusive Loss Mitigation Tip**: Choosing the agent container service of Zhongshen，you can enjoy the exclusive "pre-inspection + extended warranty filing" service for free，extend the warranty period to 7 days after arrival at the port in advance，and can additionally add guarantee clauses for cargo-related losses，completely avoiding the chain compensation risk caused by container failure.

### Answer 2

Relevant supporting documents for the agent container warranty period are important auxiliary compliance materials for export customs declaration. If structural defects such as sealing failure and frame deformation occur to the container during the warranty period and cause cargo damage, the enterprise needs to ask the agent for the official container inspection report immediately, and submit it to the customs synchronously during customs declaration, so as to avoid being judged as inaccurate declaration due to inconsistency between the actual cargo status and the declared content, which will trigger chain risks such as cargo detention, port detention fine and credit rating degradation.

In addition, if the cargo needs to be returned for repair due to container failure, you need to apply for tax-free treatment of returned goods to the customs with a valid warranty certificate, and cooperate with the customs to complete cargo status verification, to ensure the compliance of the return process and avoid additional import taxes and late payment fees.

### Answer 3

The warranty duration of agent containers varies by transportation methods and container types: the conventional warranty period for sea freight FCL is from container stuffing and departure to 30 days after vessel sailing; for LCL, which involves multiple loading/unloading and shared container, the warranty period is shortened to 15 days after vessel sailing from container stuffing and departure; the warranty period for air freight agent container is 7 days after cargo loading.

Since the damage rate of air freight containers is lower, the coverage only includes structural defects of the container. In case of abnormal situations such as rolled container and port change, you need to communicate with the agent in time to adjust the warranty period, and ask the agent to provide a re-inspection certificate of the container to ensure that the container status meets the transportation requirements, so as to avoid potential container defects not detected due to rolling, which will affect cargo safety.

### Answer 4

If the container maintenance cost occurred during the warranty period is a necessary expenditure for export cargo transportation, it can be included in the cost of export goods and deducted before corporate income tax. If an enterprise applies for extending the agent container warranty period, the extended warranty fee paid can only be used for VAT input tax deduction after obtaining the formal VAT special invoice issued by the agent.

In addition, for export enterprises adopting the VAT deferral policy, the agent container warranty and extended warranty fees need to be included in the cross-border tax cost accounting system, so as to avoid errors in VAT deferral declaration caused by incomplete cost accounting, which will trigger tax inspection risks. At the same time, you need to keep warranty agreements, expense invoices and other materials for inspection by tax authorities.

### Answer 5

If a claim is generated due to agent container failure, the enterprise needs to ensure the compliance of the payment and collection process. The claim is a subordinate expense related to cargo trade, and must be clearly marked as "agent container failure claim" when declaring foreign-related payment and collection, and provide supporting documents such as warranty agreement, container failure inspection report and claim letter, so as to avoid being identified as abnormal payment and collection by the foreign exchange administration, which will trigger risks such as account freezing and foreign exchange verification.

In addition, if you use RMB cross-border payment (CIPS) to settle the claim, you need to ensure the transaction background is true and compliant, and keep complete transaction materials including warranty agreement, failure certificate and claim confirmation for subsequent inspection by the foreign exchange administration, so as to ensure the smooth progress of cross-border payment and collection.

### Answer 6

When signing a foreign trade agency contract, the core legal clauses of agent container warranty must be clearly defined: including the start and end nodes of the warranty period, coverage, exemption cases, claim process, etc. It should be specially noted that the default industry warranty period has no legal binding force, and must be subject to written contract clauses.

If a cargo damage dispute is caused by agent container failure, it needs to be resolved through negotiation or arbitration with written warranty agreement, container failure inspection report, cargo damage certificate and other materials. In addition, it should be stipulated in the contract that if the agent fails to provide warranty service as agreed, it shall bear joint and several liability for cargo damage and customer claim, so as to clarify the rights and obligations of both parties and avoid legal disputes caused by vague clauses.

### Answer 7

For cargos with high requirements for storage environment (such as precision instruments and fragile goods), targeted packaging is required according to container status even during the warranty period. For example, if there is slight sealing failure of the container during the warranty period, you can reduce the risk of moisture damage and collision damage by adding moisture-proof waterproof film and high-density buffer air cushion to the outer packaging of the cargo.

In addition, you need to cooperate with the agent to complete container inspection before stuffing, and check the temperature and humidity, sealing performance, floor flatness and other indicators of the container to ensure that the container status matches the packaging requirements of the cargo. If the container fails during the warranty period, you need to check the cargo packaging immediately and take clear photos of the packaging damage as important supporting materials for claim, so as to improve the success rate of claim.
