# What compliance procedures and document requirements apply to customs declaration of gifts in transit trade?

## Question

I am a foreign trader mainly engaged in Southeast Asia transit trade. Last week, I shipped a batch of transit goods to the EU, which included 50 sets of customized accessories worth about CNY 8,000 as gifts for downstream purchasers. I have never handled such situations before, and now the freight forwarder is urging me to supplement customs declaration documents, which makes me very anxious: First, I do not know what category to declare these gifts under, and whether they will be taxed as normal goods; Second, I heard that false declaration will lead to customs detention, so the whole shipment will be stranded at the port, with daily container detention fees and storage fees being extremely high; Third, the transit port of this transit trade is in Singapore, will local customs requirements for gifts be different from those in China? I am really afraid that a wrong operation will not only make me lose the cost of the gifts, but also ruin the whole order!

### Answer 1 — Best Answer

**Pre-document review details**: Three types of core documents need to be prepared in advance. First，the correlation statement between gifts and main goods，clarifying that gifts are supporting materials provided free of charge along with the main transit goods，Second，value certificates of gifts，such as purchase cost invoices and free gift letters issued by suppliers，Third，supplementary clauses of the main transit trade contract，indicating the quantity，specification and gift attribute of the gifts，to ensure all documents are logically consistent without contradictions.

**Core node connection**: When declaring customs in China，it is necessary to clearly mark "free gifts for transit trade，circulated with main goods" in the "Remarks Column" of the customs declaration form，and list the commodity code，quantity and value of gifts separately，When declaring customs at the transit port，submit the full set of gift documents issued in China simultaneously to ensure the declaration information of main goods and gifts is completely matched，so as to avoid customs queries caused by information disconnection.

**Emergency plan and compliance implementation**: If the customs at the transit port raises price assessment queries，submit the purchase voucher and gift agreement of gifts immediately as evidence，If customs detention occurs，entrust a local compliance agent to submit a written explanation as soon as possible，and apply for priority inspection of gifts to reduce the detention time of main goods，All documents shall be retained for at least 3 years for subsequent retrospective verification by the customs，so as to ensure a closed loop of compliance throughout the process.

### Answer 2

When declaring gifts in transit trade to customs, it is necessary to strictly distinguish between "gifts" and "sample advertising goods". A common mistake is to declare gifts as samples. If the value exceeds the sample tax exemption limit specified by the customs, it will trigger tax repayment and even fines.

The commodity code, quantity and value of gifts shall be listed separately on the customs declaration form, and the remarks column must clearly indicate "free gifts for transit trade, circulated with main goods". Meanwhile, the transit trade contract of main goods and the gift agreement shall be submitted as evidence.

If the customs raises price assessment queries, provide the purchase cost invoice of gifts and the free gift certificate issued by the supplier to avoid being identified as "concealed goods value". If it is necessary to delete the declaration form and resubmit, ensure the declaration logic of gifts and main goods remains consistent, and do not modify the declaration information of gifts alone.

### Answer 3

Gifts in transit trade shall be circulated in the same transportation batch as main goods, and shall not be transported separately, otherwise they will be identified as independent goods by the customs and need to go through separate transit declaration procedures. When booking space, it is necessary to mark "including XX pieces of free gifts" on the manifest to ensure the manifest information is consistent with the customs declaration information, so as to avoid machine inspection or manual inspection caused by manifest inconsistency.

The application for free storage period at the transit port shall cover both gifts and main goods simultaneously. If port detention is caused by abnormal gift declaration, coordinate with the local agent to apply for extending the free storage period as soon as possible, and submit a compliance explanation to the customs to reduce the expenditure of container detention fees and storage fees. Gift information shall be noted on the bill of lading to avoid disputes caused by inconsistency between the bill of lading and goods when the downstream party picks up goods.

### Answer 4

Gifts in transit trade are goods provided free of charge, and it is necessary to confirm whether they involve the deemed sales situation of value-added tax. If gifts are purchased domestically, keep purchase vouchers and gift agreements to prove their correlation with the main goods of transit trade, so as to avoid being identified as domestic sales for tax collection by the tax authority.

If gifts are purchased overseas, ensure the taxes and fees in the procurement link have been paid in compliance, and the local VAT policy at the transit port shall be verified in advance. Some countries exempt import VAT on gifts in transit trade, but relevant certificates of free gift need to be submitted. At the same time, the cost of gifts shall be included in the overall cost accounting of transit trade to avoid tax letter investigation caused by irregular cost listing.

### Answer 5

The foreign exchange collection and payment of gifts in transit trade shall be kept compliant. Since gifts are provided free of charge, there is no corresponding foreign exchange receipt or payment. It is necessary to note "free gifts for transit trade, no corresponding foreign exchange receipt or payment" in the cross-border receipt and payment declaration system, so as to avoid being identified as abnormal foreign exchange receipt and payment by the foreign exchange administration.

If gifts involve offshore account operation, ensure the account flow is clear, separately record the logistics and document information of gifts, and avoid confusion with the receipt and payment flow of other goods. At the same time, comply with the filling specifications of SWIFT messages. If the transit port needs messages to prove gift information, clearly indicate the value, quantity and gift attribute of the gifts in the message.

### Answer 6

Gifts in transit trade shall be clearly stipulated with gift clauses in the trade contract of main goods to avoid subsequent legal risks caused by ownership or disputes. The gift agreement shall clarify the quantity, specification and value of gifts, as well as the core content of "provided free of charge and transited with main goods", and also stipulate the division of responsibilities if main goods are detained at the port or losses are caused by abnormal gift declaration.

If gifts involve intellectual property rights, handle the intellectual property customs protection filing in advance to avoid being detained by the customs due to infringement. In addition, ensure the transportation terms of gifts are consistent with those of main goods, so as to avoid disputes over ownership transfer caused by differences in trade terms.

### Answer 7

If gifts in transit trade are inspected on site by the customs, when cooperating with unpacking inspection, ensure the packaging labels of gifts and main goods are consistent, so as to avoid being identified as independent goods due to packaging differences. If gifts are dangerous goods, submit the MSDS and dangerous goods packaging certificate in advance to ensure the packaging meets the customs requirements of the transit port.

If abnormal images appear during machine inspection, submit the explanation materials of gifts to the customs as soon as possible to avoid sending for inspection and identification due to misunderstanding. After the inspection is completed, keep the inspection records and documents signed and sealed by the customs as subsequent compliance certificates.

### Answer 8

The planning of gifts in transit trade shall be included in the overall supply chain cost accounting, and the impact of the value and quantity of gifts on the transit process shall be evaluated in advance to avoid additional logistics and compliance costs caused by gifts. When selecting a transit port, priority shall be given to ports with relatively loose policies on gift declaration, such as Singapore, Hong Kong and other transit hubs, to reduce the risk of abnormal declaration.

At the same time, establish an inventory linkage mechanism for gifts to ensure the inventory circulation of gifts and main goods is synchronized, so as to avoid affecting the overall transit timeliness due to delayed gift preparation. In addition, by optimizing the trade structure, the cost of gifts can be reasonably allocated to the quotation of main goods, so as to reduce the compliance risk of separate declaration.
