# What compliance requirements, market demand and logistics carrying capacity should be considered when determining the transit trade volume?

## Question

I am the head of a foreign trade company in Shanghai focusing on mid-to-high-end home appliance export. Last week, we finalized an order of 120,000 units from the EU, but since the EU's anti-dumping duty on our product category is still in force, we can only adopt the transit route via Malaysia. Now we are stuck on the determination of transit trade volume: we previously reported the full order volume to the freight forwarder, who said that the storage stacking and transshipment capacity of Port Klang has reached 80% next month, and forcing the full volume may lead to port detention and high detention charges. The finance department also said that full-order transit will increase capital occupation by at least 30%, and there is a huge compliance risk if the EU customs traces the origin of the goods. Worse still, the end customer is urging for the stock preparation plan. I am so anxious that I can barely eat. I am afraid that splitting the order into small batches will affect delivery efficiency and make us lose long-term cooperation, while too large volume will cross the red line and cause cost loss. What dimensions should I refer to to accurately determine the transit trade volume?

### Answer 1 — Best Answer

First，complete dual verification of pre-documents and data: verify the real order details of the end customer one by one (including the time window for split delivery，batch limit for customs clearance in the destination country)，the transit access quota of the transit country (such as the weekly transshipment capacity cap for home appliances at Port Klang，Malaysia)，and the production and delivery cycle of domestic suppliers，**focus on confirming whether the end order allows split customs declaration and delivery**，to avoid triggering customs alerts caused by mismatch between documents and actual trade volume.

Realize three-party coordination and alignment at core nodes: conduct linked calibration of transit trade volume with the weekly transshipment capacity of the transit port，container space for domestic shipment，and customs clearance capacity of the destination country. For example，the weekly processing cap for home appliance transit at Port Klang is about 20,000 units per container type，it is recommended to approve the single-batch transit volume at 70% of this cap，**to avoid port detention caused by exceeding the capacity threshold，which will lead to detention charges of thousands of US dollars per day on average**. Meanwhile，work with the finance department to calculate the capital occupation cost of single-batch volume to ensure it is within the cash flow bearing range.

Develop contingency response plans in advance: if the transit port has sudden space shortage temporarily，lock the reserved space of alternative transit ports (such as Port of Singapore) in advance，and agree on a 15-day delivery flexibility window with the end customer. If the destination country customs intensifies inspection efforts，split the trade volume into multiple small batches in advance，and control the volume of each batch below the routine inspection threshold of the destination country customs.

Finally realize compliance implementation: match the determined transit trade volume with documents such as the Certificate of Origin of the transit country，transshipment bill of lading，and domestic customs declaration form one by one，to ensure the consistency of goods，documents，payment and flow. **Keep full-chain transaction records for no less than 5 years**，to avoid the situation that you cannot provide evidence when the destination country customs traces the origin of goods later.

### Answer 2

The determination of transit trade volume shall strictly match the declaration logic of customs declaration forms. It shall be ensured that the transit trade volume is completely consistent with the declaration data of the domestic export customs declaration form, transit country transshipment customs declaration form, and destination country import customs declaration form. "Declaring more than actual transit volume" or "declaring less than actual transit volume" is strictly prohibited.

If the deviation between the declared volume and the actual cargo volume exceeds 5%, it will trigger the customs valuation and inspection alert. In minor cases, you will be required to delete the declaration and resubmit, while in serious cases, it will be identified as false trade, facing fines and credit rating downgrade. In addition, it shall be combined with the anti-dumping duty avoidance requirements of the destination country.

If the origin verification requirement of the destination country for transit products is "the value-added rate in the transit country shall not be less than 30%", the transit trade volume shall match the scale of value-added operations in the transit country. For example, the value-added services (such as simple processing, packaging) corresponding to each batch of transit volume shall meet the value-added rate requirement, to avoid being directly traced as products originating in China.

### Answer 3

The determination of transit trade volume shall be combined with the storage conditions of the transit port and the space carrying capacity of the transshipment route. For example, the open storage area of Port Klang can only store home appliance goods for no more than 10 days.

If the single-batch transit volume is too large and exceeds the carrying capacity of the storage area, the goods will be arranged to the bonded warehouse with higher charges, and for each additional day of detention, the detention charge and storage fee will increase by about 15%. Meanwhile, it shall match the space quota of direct transshipment.

If the selected transshipment shipping company can only provide 2 40HQ spaces for home appliance transit every week, the single-batch transit volume shall be controlled within the cargo volume of 2 containers, to avoid cargo backlog at domestic ports caused by insufficient space, which will generate additional storage fees and empty container charges. In addition, verify the unpacking inspection ratio of the transit port in advance. If the unpacking inspection ratio exceeds 20%, split the trade volume into multiple small batches to reduce the probability of the whole order being inspected.

### Answer 4

The determination of transit trade volume shall be combined with the demand for cross-border tax planning. For example, if the transit country implements the VAT deferral policy, the single-batch transit volume shall match the VAT deferral declaration cycle. For example, the VAT deferral declaration cycle in Malaysia is once a month, and the VAT amount corresponding to the single-batch transit volume shall be within the monthly declaration limit, to avoid being unable to enjoy the deferral policy due to exceeding the limit, which will lead to advance payment of high VAT funds. Meanwhile, it shall be combined with the requirements of related party transaction pricing.

The transit profit corresponding to the transit trade volume shall conform to the BEPS profit level range. If the single-batch transit volume is too large, leading to the transit profit ratio exceeding 30%, it will be identified as profit shifting by the tax authority, facing anti-avoidance investigation. In addition, it shall match the declaration requirements of domestic export tax rebate. The domestic export customs declaration form corresponding to the transit trade volume shall meet the document filing requirements for export tax rebate, to avoid being unable to get tax rebate normally due to incomplete document filing caused by excessive volume.

### Answer 5

The determination of transit trade volume shall strictly match the compliance requirements of cross-border receipt and payment of foreign exchange. It shall be ensured that the difference between the receipt amount and payment amount corresponding to the transit trade volume conforms to the normal trade profit range (generally 5%-15%). If the difference exceeds 20%, it will be identified as abnormal receipt and payment by the bank, triggering manual review of SWIFT messages, leading to 10-15 days delay in foreign exchange receipt. Meanwhile, it shall be combined with the transaction limit of the offshore account.

If the monthly transaction limit of the offshore account used is 500,000 US dollars, the cargo value corresponding to the single-batch transit volume shall be controlled within 500,000 US dollars, to avoid account freezing caused by exceeding the limit. In addition, it shall match the requirements of CIPS RMB cross-border payment. If RMB settlement is selected, the RMB receipt and payment amount corresponding to the transit trade volume shall be consistent with the cargo value on the customs declaration form. The deviation between the receipt and payment amount and the cargo value exceeding 10% is strictly prohibited, to avoid triggering compliance alert for cross-border RMB settlement.

### Answer 6

The determination of transit trade volume shall be combined with the terms of international trade contracts. It shall be ensured that the transit trade volume is completely consistent with the cargo volume terms in the procurement contract of the end customer, the agency contract of the transit service provider, and the supply contract of the domestic supplier, to avoid contract disputes caused by mismatch between contract terms and actual trade volume. If the procurement contract of the end customer stipulates that "0.5% of the contract value shall be paid as liquidated damages per day for overdue delivery", the transit trade volume shall match the promised delivery cycle of the transit service provider.

For example, if the service provider promises to complete transshipment within 15 days, the single-batch transit volume shall be controlled within its 15-day processing capacity, to avoid triggering the liquidated damage clause due to overdue delivery. In addition, add a fallback clause in the contract stipulating that "the service provider shall bear part of the responsibility for delivery delay caused by insufficient capacity of the transit port", to avoid bearing all risks caused by unreasonable determination of trade volume by your side alone.

### Answer 7

The determination of transit trade volume shall be combined with the on-site inspection requirements of the transit port. For example, the inspection ratio of home appliance goods by the customs of Port Klang is 15%. If the single-batch transit volume exceeds 5 40HQ containers, it will be listed as a key inspection object, the inspection ratio will be increased to more than 50%, and the inspection time will be extended from 2 days to 7 days, generating additional inspection fees and port detention charges. Meanwhile, it shall match the unpacking conditions of the inspection site.

If the inspection site of the transit port can only accommodate unpacking operations of 2 containers at the same time, the single-batch transit volume shall be controlled within 2 containers, to avoid port detention caused by queuing for unpacking. In addition, verify the seal management requirements of the transit port in advance. If the single-batch transit volume is too large, and the number of seals used exceeds the daily issuance limit of the customs, you will not be able to complete the sealing operation in time, leading to the failure of goods to be shipped on schedule.

### Answer 8

The determination of transit trade volume shall be combined with the inventory linkage strategy of the supply chain. Conduct linked calibration of transit trade volume with the safety stock of domestic suppliers and the demand forecast of end customers. For example, if the monthly demand of the end customer is 30,000 units, the single-batch transit volume shall be controlled within 30,000 units, to avoid terminal inventory backlog caused by excessive transit, which will increase inventory holding costs. Meanwhile, combine with the cost actuarial model to comprehensively calculate the tariff cost, logistics cost and capital cost corresponding to the transit trade volume.

For example, when the single-batch transit volume is 20,000 units, the comprehensive cost per unit value is the lowest (about 8% of the cargo value). If it exceeds 20,000 units, the unit cost will rise to more than 12%, so it is recommended to take 20,000 units as the optimal value of single-batch transit volume. In addition, it shall match the conversion requirements of CIF/FOB trade terms. If CIF terms are used, the transit trade volume shall match the underwriting scope of transportation insurance, to avoid disputes in insurance claims caused by excessive volume.
