# What Exactly Is the Transit Trade Whitelist? Is It a Customs-Approved List of Specific Enterprises?

## Question

I am the head of a foreign trade enterprise in Shanghai specializing in transit trade with Southeast Asia. Last week, a batch of solid wood furniture shipped to the EU was randomly inspected by local customs during transit at Port Klang, Malaysia. My freight forwarder told me that if we were on the transit trade whitelist, we could enjoy priority clearance treatment. I had never heard of this list before. Now the container has been detained at the port for 4 days, incurring nearly RMB 2,000 in port detention and container detention fees per day, and the customer is constantly urging for delivery. I am extremely anxious and would like to ask what exactly the transit trade whitelist is? Is it a specific list of compliant enterprises recognized by customs? Can inclusion really avoid such risks of port detention and cargo seizure? Can enterprises like ours that already carry out transit business apply for inclusion retroactively?

### Answer 1 — Best Answer

Many foreign trade enterprises have a misunderstanding that the transit trade whitelist is a "customs clearance green channel" that can be purchased with money. In fact，it is a list of high-credit transit entities recognized by customs based on dimensions such as the enterprise's compliance history，risk control capability，and document management level，and access is never granted upon payment.

If not included in the whitelist，enterprises will be listed as high-risk inspection targets in the transit link. In addition to the port detention and cargo seizure you encountered，they may also trigger cross-border tax audits，or even be restricted from carrying out transit business，which will greatly increase the difficulty of applying for the whitelist later.

The core measure for physical risk isolation is **complete compliance qualification filing in advance**: first conduct a self-inspection of transit contracts，bills of lading，foreign exchange receipt and payment vouchers in the past 3 years to ensure **four-flow consistency**，then submit the Transit Trade Compliance Entity Filing Form and relevant supporting materials to the local customs，and you will be included after passing the customs' risk control review.

For your current port detention crisis，the exclusive loss-stopping tip is: ask your cooperating freight forwarder to submit your enterprise's compliant transit records of the past 3 years，apply for **emergency compliance filing** with the customs of Port Klang，Malaysia to strive for priority release，meanwhile，apply for compensation of port detention fees from the cargo insurance company simultaneously to reduce losses.

### Answer 2

Enterprises on the transit trade whitelist can enjoy the three preferential policies of "priority document review, priority inspection, priority release" when declaring customs. The customs document review time is shortened from 24-48 hours for ordinary enterprises to 4-8 hours.

It should be noted that the customs declaration documents of whitelist enterprises must strictly meet the core requirement that "transit goods do not enter domestic consumption". The destination port on the bill of lading and manifest must be consistent with the location of the final consignee.

If the documents are inconsistent, you will not only be removed from the whitelist, but also trigger valuation disputes. You need to submit supporting materials such as the transit contract of the goods and overseas procurement contracts, and may even be required to pay overdue tariffs.

### Answer 3

Enterprises on the transit trade whitelist can enjoy the exclusive extended storage period policy at transit ports in the logistics link. The free storage period for ordinary enterprises is 3-5 days, while that for whitelist enterprises can be extended to 7-10 days, which can effectively avoid container detention fees caused by delayed document circulation. At the same time, the cargo right transfer process for whitelist enterprises is more simplified.

They can handle endorsement transfer directly with electronic bills of lading, without submitting the original paper bills of lading, which reduces the risk of loss of cargo rights. In case of space shortage at the transit port, whitelist enterprises can get priority in space arrangement, without waiting for additional space allocation, to ensure the timely transit of goods.

### Answer 4

Enterprises on the transit trade whitelist can enjoy the VAT deferred payment policy, no need to prepay value-added tax at the transit port, and only conduct tax declaration after the goods are finally sold to the destination country, which effectively eases the capital pressure of enterprises.

At the same time, the cross-border related transaction pricing of whitelist enterprises is easier to pass the review of tax authorities, avoiding being identified as tax evasion due to unreasonable transfer pricing and triggering BEPS investigations. It should be noted that enterprises need to keep the full logistics vouchers, transaction contracts and other materials of transit goods for the inspection of tax authorities to ensure tax compliance.

### Answer 5

Enterprises on the transit trade whitelist can enjoy the simplified review policy in the foreign exchange receipt and payment link. Banks do not need to review the document materials of transit trade transaction by transaction, and only require enterprises to submit a summary list of transit business on a monthly basis to handle foreign exchange receipt and payment, which shortens the processing time of foreign exchange receipt and payment.

At the same time, whitelist enterprises can handle RMB cross-border payment through the CIPS system, enjoy more favorable exchange rate quotations, and reduce foreign exchange purchase costs. It should be noted that the foreign exchange receipt and payment amount of the enterprise must be consistent with the amount of the transit contract. If there is a large deviation, the bank will suspend the simplified foreign exchange receipt and payment authority of the enterprise, and relevant supporting materials need to be submitted for explanation.

### Answer 6

When signing a transit contract, enterprises on the transit trade whitelist can add the "whitelist exclusive compliance clause", which clarifies that if the goods are delayed due to the special supervision requirements of the customs for whitelist enterprises, part of the liability for breach of contract can be exempted.

At the same time, when applying for a bank letter of guarantee (LOI), whitelist enterprises do not need to provide additional collateral, and can reduce the guarantee fee rate only by virtue of the whitelist qualification, saving guarantee costs. It should be noted that enterprises need to regularly review the clauses of the transit contract to ensure that they meet the compliance requirements of whitelist enterprises, and avoid being removed from the whitelist due to violation of contract clauses.

### Answer 7

When the goods of enterprises on the transit trade whitelist are inspected on site at the port, they can enjoy the policy of "priority X-ray inspection, reduced unpacking ratio". The unpacking ratio is reduced from 15%-20% for ordinary enterprises to 5%-10%, which greatly shortens the inspection time. In case of abnormal X-ray inspection results, whitelist enterprises can arrange special personnel to accompany the customs inspection, and apply for the inspection and appraisal of the goods first, to avoid long-term detention of the goods at the port.

It should be noted that enterprises need to ensure that the actual situation of the goods is consistent with the customs declaration documents. If the goods and documents are inconsistent, they will not only be removed from the whitelist, but also be included in the customs dishonesty list, affecting subsequent customs clearance business.

### Answer 8

The goods packaging of enterprises on the transit trade whitelist can enjoy the simplified review policy. If the goods are non-dangerous goods, only a packaging compliance declaration is required, and no additional packaging inspection report is required. For dangerous goods, whitelist enterprises can give priority to the filing of UN dangerous goods packaging, and the filing time is shortened from 7-10 days for ordinary enterprises to 3-5 days.

It should be noted that enterprises need to ensure that the packaging of the goods meets the packaging standards of the transit port and the destination country. If the goods are detained by the customs due to unqualified packaging, it will not only incur port detention fees, but also be removed from the whitelist, affecting subsequent transit business.

### Answer 9

The export tax refund business of enterprises on the transit trade whitelist can enjoy the policy of "priority review, fast disbursement". The tax refund review time is shortened from 15-20 days for ordinary enterprises to 5-7 days, which accelerates the capital return of enterprises. At the same time, the tax refund document filing of whitelist enterprises can adopt electronic filing method, no need to submit paper documents, which reduces the document management cost.

It should be noted that enterprises need to ensure the four-flow consistency of transit business. If there are abnormal capital return, inconsistent documents and other situations, the tax authority will suspend the tax refund authority of the enterprise, and relevant supporting materials need to be submitted for verification, and may even be required to repay the already refunded tax.

### Answer 10

Enterprises on the transit trade whitelist can participate in the customs' "Transit Trade Supply Chain Collaboration Plan", establish an exclusive collaboration mechanism with logistics enterprises and customs brokers at the transit port, realize real-time sharing of logistics information, and predict abnormal situations in the transit link in advance.

At the same time, whitelist enterprises can enjoy exclusive services of supply chain cost actuarial, and reduce the overall supply chain cost by optimizing transit routes, adjusting trade terms and other methods. It should be noted that enterprises need to regularly evaluate the risks of the transit supply chain, adjust the supply chain strategy in time, ensure that it meets the compliance requirements of whitelist enterprises, and maintain the stability of the supply chain.
